The principle of oneness, also known as the principle of "one application, one invention", means that a patent application document can only file a patent application for one invention.
It is worth noting that although the principle of singularity in patent application does not allow more than two inventions to be put forward in one patent application, it does allow patent applications for technical solutions that belong to a general idea or are related, related or interdependent. As far as designs are concerned, it is allowed to file patent applications for more than two designs "used in the same category and sold or used in sets" in one application. The so-called product similarity means that products belong to the same category in the classification table; Complete set sales or use means that all products have the same design or concept and are customarily sold and used at the same time.
It can be regarded as a number of inventions belonging to the general concept of invention in an application for a patent for invention:
(1) Two or more independent claims of similar products or methods that cannot be included in one claim;
(2) the independent claim of the product and the method of manufacturing the product;
(3) the independent claim of the product and the use of the product;
(4) the independent claim of the product, the method of manufacturing the product and the use of the product;
(5) the independent claim of the product, the method specially used for manufacturing the product, and the equipment specially designed for implementing the method;
(6) the independent claims of the method and the equipment specially designed for implementing the method.
2. Writing principles
All procedures stipulated in the Patent Law and these Rules shall be handled in writing. The writing form here is the principle of writing. This principle means that in the process of patent application, patent applicants and their agents should use written forms when handling various procedures.
3. The principle of first application
The principle of prior application means that if two or more people apply for a patent for the same invention-creation, the patent right will be granted to the person who applied for the patent first.
