Article 56 of the Patent Law stipulates: "The scope of protection of the patent right for an invention or utility model shall be subject to the contents of its claims. The description and its drawings can be used to explain the claims. Therefore, the claims are legal documents used to determine the scope of patent protection for inventions or utility models. Whether the subject of a patent application belongs to the patentability scope, whether the invention and creation to be protected are novel, creative and practical, whether the patent application conforms to the provisions of oneness, and whether the implementation behavior of others infringes the patent right depends on or is directly related to the content of the patent claim. Therefore, the patent claim is the most important document in the patent application for invention and utility model.
