Chapter 1 General Provisions Article 1 In order to promote scientific and technological progress, enhance scientific and technological innovation capabilities, and build innovative cities, in accordance with the "Science and Technology Progress Law of the People's Republic of China" and other relevant laws and regulations, This regulation is formulated based on the actual situation of this city. Article 2 These regulations shall apply to those engaged in scientific research, technological innovation, transformation of scientific and technological achievements, popularization of science and technology, and related service and management activities within the administrative region of this city. Article 3 The work on scientific and technological progress shall adhere to the principles of government guidance, enterprises as the main body, market as the guide, the integration of industry, academia and research, and the joint participation of the whole society. Article 4 The Municipal People's Government leads the city's scientific and technological progress work, incorporates scientific and technological progress into the national economic and social development plans, implements national and provincial laws, regulations and policies on scientific and technological progress, and improves systems and mechanisms for promoting scientific and technological progress.

County (city, district) people's governments are responsible for scientific and technological progress within their own administrative regions. Article 5: Municipal and county (city, district) science and technology administrative departments are responsible for the organization, management, overall planning and coordination of scientific and technological progress activities within their respective administrative regions.

Other relevant departments of the municipal and county (city, district) people's governments shall work together to carry out scientific and technological progress within the scope of their respective responsibilities. Article 6 The Municipal People's Government shall establish a science and technology reward system to commend and reward organizations and individuals that have made outstanding contributions in scientific and technological progress activities.

Encourage domestic and foreign units and individuals to establish science and technology awards in this city in accordance with the law. Chapter 2 Enterprise Technological Innovation Article 7: Encourage and guide state-owned enterprises, private enterprises and other types of enterprises to increase investment in research and development. If the research and development expenses of enterprises above designated size account for 1% of annual sales revenue and high-tech enterprises reach 3% to 6% in accordance with relevant regulations, they can undertake municipal science and technology, technological transformation, innovation of small and medium-sized enterprises, and intellectual property rights. and other planned projects, enjoy the support policies of the Municipal People’s Government.

Enterprises should set up special accounting subjects, implement special account management and separate accounting for research and development expenses, and list expenses before tax and make additional deductions in accordance with the law. Article 8 The municipal and county (city, district) people's governments shall establish an innovative enterprise cultivation mechanism and provide funding for the innovative activities of enterprises with core independent intellectual property rights, advanced technological levels, and sustainable development capabilities. National and provincial innovative (pilot) enterprises and technological innovation demonstration enterprises can have priority in enjoying the support policies of the Municipal People's Government. Article 9 The municipal and county (city, district) people's governments shall improve the assessment measures for the research and development investment of state-owned enterprises, and strengthen the guidance and supervision of the research and development investment of state-owned enterprises. State-owned enterprises should gradually increase investment in research and development based on their profitability.

State-owned assets supervision and administration departments should include state-owned enterprises’ research and development investment, technological innovation capacity building, technological innovation results, and intellectual property output and application into the performance evaluation of state-owned enterprise leaders. Article 10: Encourage and guide enterprises, scientific research institutions, and universities to jointly promote research on national major technological innovation products and service standards. Enterprises that play a leading role in participating in the formulation of industry standards, national standards, and international standards shall be rewarded by the municipal and county (city, district) people's governments in accordance with relevant regulations. Chapter 3 Industry-university-research cooperation and transformation of scientific and technological achievements Article 11 encourages and supports enterprises to carry out various forms of innovative cooperation with scientific research institutions and universities, and jointly build innovation platforms such as enterprise technology research and development centers and key laboratories. Jointly carry out applied technology, basic cutting-edge technology research and talent training, jointly undertake various major scientific research projects, and jointly develop major equipment and new products. Article 12: Support scientific research institutions, universities and enterprises in improving technology transfer mechanisms, and encourage enterprises to increase investment in the transformation and industrialization of scientific and technological innovation achievements. Municipal and county (city, district) people's governments should provide key support to major achievement transformation projects that have independent intellectual property rights and can form a large economic scale and strong competitiveness. Article 13 If scientific research institutions and colleges and universities use scientific and technological projects funded by fiscal funds to transform their work achievements through technology transfer, they shall give a one-time reward of more than 20% of the net income from the technology transfer. To those who complete the work and who have made major contributions to the transformation of job achievements; if equity investment is used to implement transformation, the equity used for rewards should account for more than 20% of the shares of the scientific and technological achievements.

For job achievements resulting from science and technology projects established with fiscal funds, upon application by the person who completed the project, the project undertaking unit may approve their own transformation, and the income earned will be distributed according to the agreement. Article 14 The project undertaking unit shall implement and protect the patent rights, computer software copyrights, integrated circuit layout design exclusive rights and new plant variety rights formed by scientific and technological projects established with fiscal funds in accordance with the law, and shall make arrangements for implementation and protection. Submit annual reports on conservation status to the project management department. If the project undertaking unit meets the conditions for implementation and fails to implement it within three years without justifiable reasons, the municipal or county (city, district) people's government may implement it free of charge, or permit others to implement it with or without compensation. Article 15: Units and individuals may legally establish science and technology intermediary service agencies such as productivity promotion, technology assessment, technology brokerage, science and technology consulting, and patent agency.

Municipal and county (city, district) people's governments should establish and improve the government procurement system and technology market management system for public science and technology services, and conduct social public affairs affairs that are highly professional and technical. and technical service matters that can be entrusted to a science and technology intermediary service agency, they should be entrusted to a science and technology intermediary service agency.
