Legal analysis: the crime of false accusation and frame-up is a public prosecution case. There are five cases of private prosecution, corresponding to four articles of the Criminal Law, namely: insult and slander (Article 246), violent interference with freedom of marriage (Article 257), abuse (Article 260) and embezzlement (Article 270). In the case of private prosecution, there is a sentence in the clockwork: "All talk and no action."
Legal basis: Article 171st of the Criminal Procedure Law of People's Republic of China (PRC). If the private prosecutor refuses to appear in court without justifiable reasons after being summoned twice according to law, or withdraws from court halfway without the permission of the court, the prosecution shall be dismissed.
