Three Provisions of Preventive Intervention in Justice

Leading cadres must strictly abide by the provisions on the record, notification and accountability of leading cadres' intervention in judicial activities and handling specific cases. If there are parties to the case, please intercede; Require the person handling the case or the person in charge of the unit to meet the parties or interested parties in private; Through various forms, put forward the tendentious opinions and specific requirements for handling cases beyond the authority; Those who illegally interfere with judicial activities or obstruct judicial justice in other ways will be recorded, and at the same time, they will report to the party committees at the same level, discipline inspection and supervision organs and party Committee organizations, and the relevant responsibilities will be investigated according to the law and regulations until criminal responsibility is investigated. The internal personnel of the judicial organ shall strictly abide by the provisions on the record and accountability of cases questioned by the internal personnel of the judicial organ. Do not ask questions or interfere with cases being handled by other personnel in violation of regulations; Not to meet the parties to the case or other interested parties in private; Shall not, in violation of the provisions, transfer the materials involved or inquire about the case for the parties to the case; Do not plead for the parties to the case, inquire about the case, or tip off the news in any way. If there is any violation of the above provisions, the case-handling personnel will comprehensively and truthfully record the relevant situation, and report to the discipline inspection and supervision department of the judicial organ where the violator is located or the discipline inspection and supervision department with cadre management authority, and investigate the relevant responsibilities according to the law and regulations until criminal responsibility is investigated. Judicial personnel must strictly abide by the "Several Provisions on Further Standardizing the Communication between Judicial Personnel and Parties, Lawyers, Special Relationships and Intermediary Organizations". Shall not disclose the secrets of judicial organs handling cases or other circumstances that are not allowed to be disclosed by laws and regulations; Do not recommend agents ad litem or defenders for the parties, do not introduce cases to lawyers or intermediary organizations, and do not ask, suggest or imply that the parties should change lawyers who meet the requirements for agency; Shall not accept the parties, lawyers, special relations, intermediary organizations to entertain guests and give gifts or give other benefits; Shall not engage in malpractices for selfish ends in entrusted evaluation, auction and other activities, maliciously collude with relevant intermediaries and personnel, resort to deceit, and operate illegally; Do not engage in other improper contacts with parties, lawyers, special interest parties or intermediary organizations. In violation of regulations, if verified, relevant responsibilities will be investigated according to laws and regulations until criminal responsibility is investigated.
