How long can a criminal case be handed over to the procuratorate to be closed?

According to the Criminal Procedure Law of People's Republic of China (PRC), general criminal cases go through three stages, namely, investigation stage (public security organs), examination and prosecution stage (people's procuratorate) and trial stage (people's court). ? In the investigation stage, the public security organ will take criminal detention according to the situation, and submit it to the procuratorate for approval to arrest within three days, which can be extended for one to four days, and the longest can be extended to 30 days. Generally, the procuratorate will decide whether to approve the arrest within seven days, which can be 3- 10 days at the earliest. The investigation period after arrest shall generally not exceed two months, and the case with complicated circumstances may be extended by one month with the approval of the people's procuratorate at the next higher level. If it is an area with inconvenient transportation, a major criminal group case, a fugitive crime, etc. With the approval of the provincial procuratorate, it can be extended for another two months. With the approval of the provincial procuratorate, the criminal suspect who may be sentenced to a penalty of less than ten years will be extended for another two months. The stage of review and prosecution is generally one month, and it can be extended for half a month if the circumstances are serious and complicated. If the procuratorate deems it necessary to make supplementary investigation after examination, it may return it to the public security organ for supplementary investigation or conduct investigation on its own. Supplementary investigation shall be completed within one month, and supplementary investigation shall be limited to two times. In the trial stage, if there is no appeal or protest, it is usually two months, and the longest is six months. To sum up, for criminal cases, there is only the stipulation of the longest closing time, but not the stipulation of the fastest closing time. According to 208th Article of the Criminal Procedure Law of People's Republic of China (PRC), after accepting a case of public prosecution, the people's court shall pronounce a sentence within two months, and not more than three months at the latest. For a case that may be sentenced to death or an incidental civil lawsuit, if one of the circumstances stipulated in Article 158 of this Law occurs, it may be extended for three months with the approval of the people's court at the next higher level; Due to special circumstances need to be extended, it shall be submitted to the Supreme People's Court for approval. If the people's court changes its jurisdiction, it shall be counted from the date when the changed people's court receives the case.
