For cases that require protest, the review and prosecution department shall submit them to the chief prosecutor for decision; for difficult or complex cases, the chief prosecutor shall submit them to the procuratorial committee for discussion and decision.

Article 400: The people’s procuratorate shall lodge a protest against the first-instance judgment of the people’s court at the same level within ten days from the date of receipt of the judgment; the protest against the ruling shall be made within the second day of receipt of the ruling.
