Legal basis: "People's Procuratorate Criminal Procedure Rules"
Article 399: After receiving the judgment or ruling of the first-instance People's Court, the People's Procuratorate shall review it in a timely manner. The person in charge shall fill in the criminal judgment and ruling review form, put forward handling opinions, and submit it to the person in charge of the review and prosecution department for review. For cases that require protest, the review and prosecution department shall submit them to the chief prosecutor for decision; for difficult or complex cases, the chief prosecutor shall submit them to the procuratorial committee for discussion and decision.
Article 400: The people’s procuratorate shall lodge a protest against the first-instance judgment of the people’s court at the same level within ten days from the date of receipt of the judgment; the protest against the ruling shall be made within the second day of receipt of the ruling. Submit within five days.
