Article 3: Lawyers must abide by the Constitution and laws, and abide by lawyer professional ethics and practice disciplines.
Lawyers’ practice must be based on facts and the law as the criterion.
Lawyers’ practice should be subject to supervision by the state, society and parties.
Lawyers' practice in accordance with the law is protected by law, and no organization or individual may infringe on lawyers' legitimate rights and interests.
Article 4 The judicial administrative department shall supervise and guide lawyers, law firms and bar associations in accordance with this Law.
Article 49 If a lawyer commits any of the following acts, the judicial administrative department of the people's government of a city divided into districts or a municipality directly under the Central Government shall impose a penalty of suspension of practice for not less than six months but not more than one year, and may also be fined five years: A fine of less than 10,000 yuan; if there is any illegal income, the illegal income will be confiscated; if the circumstances are serious, the judicial administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall revoke his lawyer's practicing certificate; if a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) Violate regulations to meet with judges, prosecutors, arbitrators and other relevant staff, or otherwise affect the handling of cases according to law;
(2) Report to judges, prosecutors, arbitrators and other Relevant staff members offer bribes, introduce bribes, or instigate or induce parties to pay bribes;
(3) Providing false materials to judicial administrative departments or committing other fraudulent acts;
(4) Intentionally Providing false evidence or threatening or inducing others to provide false evidence, hindering the other party from obtaining evidence in accordance with the law;
(5) Accepting property or other interests from the other party, maliciously colluding with the other party or a third party, infringing The rights and interests of the client;
(6) Disturbing the order of the court or arbitration tribunal, interfering with the normal conduct of litigation and arbitration activities;
(7) Inciting or instigating the parties to take actions that disrupt public order, Endangering public security and other illegal means to resolve disputes;
(8) Making remarks that endanger national security, maliciously slandering others, and seriously disrupting court order;
(9) Leaking state secrets of.
If a lawyer is subject to criminal punishment for intentional crimes, the judicial administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall revoke his lawyer's practicing certificate.
