Ask the criminal lawyer of Pu 'er for advice.
People often compare criminal suspects to patients and lawyers to doctors. However, in people's eyes, the biggest difference between lawyers and doctors is that doctors' mistakes may lead to death, while lawyers will never. As a lawyer, I always think so. However, the situation I encountered in a recent case will completely subvert this understanding. After Chen Moumou of Jinghong was arrested by Pu 'er City Procuratorate for allegedly transporting drugs, his relatives found me in Kunming. As soon as I accepted the entrustment, I rushed to Pu 'er, accompanied by investigators, and met Chen. After the case was transferred to the procuratorate for review and prosecution, after meeting with Chen and exchanging opinions with prosecutors, I grasped the fact that Chen sent a message at Pu 'er Detention Center asking Yang, a co-suspect, to admit that he had taken the phone call from the fugitive drug dealer and seized the note he carried with the case. A case that originally proved that Chen was suspected of transporting drugs had insufficient evidence and turned sharply. Not only was the effort not to prosecute not accepted, but Chen was also worried about his life. It turned out that Chen was entrusted by the same used car business to help him send his car and money to Kunming, because he agreed to go to the used car market by the way. On the way from Jinghong to Simao, let Chen pick up Yang and go with him. Later, when the border guards checked, they seized more than 9000 grams of drugs in the back seat of the car. Yang confessed to the act of helping to buy drugs, and assisted the investigation agency in arresting Yan, who helped Yang buy drugs. Yanmou also confessed to the facts of the crime, while Chen Mou always argued that he was innocent and refused to sign the record of drug identification and drug weighing. Chen Moumou, Yang Moumou and Yan Mou were detained in Pu 'er City Detention Center. After Chen was detained, his relatives hired a lawyer for him in Jinghong city. However, it was not until Chen was arrested according to law after being detained for more than 30 days that the hired lawyer went to Pu 'er to meet Chen. Chen was in a hurry and wrote to ask his family to get him a lawyer quickly. After my intervention, Chen made a big mistake. I asked why I did it. Chen said that because he had never seen a lawyer pick him up, he was very anxious and asked his fellow prisoners to write down what the investigators told him. When he wanted to be on an equal footing with the suspect's lawyer in prison, he brought it to help him see what he should do. As a result, the note was always in his trouser pocket and was seized by the detention center. Regarding the fact that the party sent a message to Yang acknowledging receiving the call, Chen said that he didn't know what to do without the help of a lawyer, because he felt wronged and was used. He hoped that Yang Neng would tell the truth, so he sent a message through the client, and the client knew that he had been reported. Regarding drug crimes, knowing or not is the benchmark of crime and non-crime. I have successfully defended the suspect suspected of transporting 40 kilograms of heroin, because he did not have several presumptive knowing behaviors stipulated in the judicial interpretation. What Chen did in the detention center undoubtedly gave people an opportunity. The reason is that although Chen did it himself, the lawyer did not act, which made him unable to get the help of his lawyer in time and made him stupid, and the lawyer had an unshirkable responsibility. I will naturally try my best to defend Chen, but it is worth mentioning that the inaction of lawyers is as harmful as that of doctors. Remember the client, remember the lawyer!
