Whoever knowingly hurts others with a knife is suspected of intentional injury and shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever intentionally causes serious injuries with a knife shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.

(4) If intentional injury causes death, the starting point of sentencing can be determined within the range of fixed-term imprisonment of not less than 10 years but not more than 15 years. Except for those who should be sentenced to life imprisonment or more according to law.

2. On the basis of the starting point of sentencing, increase the penalty and determine the benchmark penalty according to the criminal facts that affect the composition of the crime, such as the consequences of casualties, the level of disability, and the cruelty of means.

In any of the following circumstances, the corresponding fine can be increased and the benchmark fine can be determined:

(1) For each minor injury, the sentence can be increased by one month to two months;

(2) The term of imprisonment can be increased from three months to six months for each minor injury;

(3) For each additional seriously injured person, the sentence can be increased by one to two years;

(4) If the victim is disabled from 10 to 7, the sentence can be increased by one month to three months for each level of disability.
