(1) Deputy directors and standing committees of the special committees of the State People’s Congress Deputy Secretary-General, Directors and Deputy Directors of the Office of the Standing Committee and various working committees;
(2) Deciding on candidates for Secretary-General, Directors of work departments and Directors of the State People’s Government;
(3) The vice-president, members of the judicial committee, president, vice-presidents, and judges of the National Intermediate People's Court are proposed for appointment;
(4) The deputy procurator-general, members of the Procuratorial Committee, and prosecutors of the State People's Procuratorate are proposed for appointment member. Article 4 The nominating agency shall submit the list of persons to be appointed to the Personnel Representative Working Committee of the Standing Committee of the State People’s Congress in writing ten days before the meeting of the Standing Committee of the State People’s Congress. Article 5 The legal knowledge examination is based on the question bank system. The examination scope is the public part of law and the law-related part. It is divided into two basic test questions, A and B, according to the different nature of the work of the test subjects.
Part of the public law: Constitution, local organizational law, election law, representative law, supervision law, civil servant law, administrative procedure law, autonomous prefecture autonomy regulations.
Type A issues apply to the personnel mentioned in Items (1) and (2) of Article 3 of these Measures. In addition to some laws, relevant laws include basic legal theory, legislative law, state compensation law, administrative penalty law, administrative licensing law, etc.
Type B test questions are applicable to the personnel mentioned in Items (3) and (4) of Article 3 of these Measures. In addition to some laws, relevant laws include the Court Organization Law, the Judges Law, the Procuratorate Organization Law, the Prosecutors Law, the Criminal Law, the Criminal Procedure Law, the General Principles of Civil Law, and the Civil Procedure Law. Article 6 The specific time and place of the legal knowledge examination shall be notified by the Personnel Representative Working Committee of the Standing Committee of the State People's Congress to the unit where the reference person is located five days before the examination. The unit where the reference person is located shall be communicated to the reference person in a timely manner. Article 7 Whether to take the legal knowledge examination shall be decided by the meeting of directors of the Standing Committee of the State People's Congress based on the different nature of the work before and after taking office. Article 8 The legal knowledge examination shall adopt a centralized open-book written examination. Article 9 Candidates should abide by the examination room discipline and complete the answer sheet independently within the specified time. Article 10 The evaluation shall follow the principles of fairness, impartiality and strictness. Article 11 The legal knowledge examination results shall be based on a hundred-point system. Those who score more than 60 points can be submitted to the Standing Committee of the State People's Congress for review; those who score less than 60 can take a make-up test, and those who pass the make-up test will be submitted to the next Standing Committee meeting for review. Article 12 The results of the legal knowledge examination shall be reported by the Personnel Representative Working Committee of the Standing Committee of the State People's Congress to the director's meeting or the standing committee meeting, with a copy sent to the relevant departments and agencies, and the reference personnel shall be informed.
If the reference person has objections to his or her test scores, he or she may apply for review to the Personnel Representative Working Committee of the Standing Committee of the State People's Congress within 7 days from the date of receipt of the test scores. Article 13 These Measures shall come into effect from the date of adoption.
