Legal analysis: the mechanism of direct prosecution of criminal detention refers to cases under the jurisdiction of grassroots people's courts that may be sentenced to fixed-term imprisonment of less than three years. If the facts of the case are clear, the evidence is true and sufficient, and the criminal suspect pleads guilty and admits punishment, the public security organ may, with the consent of the criminal suspect, detain him without asking for examination and approval of arrest or changing compulsory measures, and directly transfer him to the people's procuratorate for examination and prosecution after the investigation is completed. Public security organs, people's procuratorates and people's courts shall complete investigation, prosecution and trial within the period of criminal detention. The criminal detention direct prosecution mechanism is applicable. If the criminal suspect or defendant fails to entrust a defender to handle the case, the people's court, the people's procuratorate and the public security organ (detention center) shall promptly notify the lawyer on duty to provide legal aid. If a criminal suspect or defendant refuses to be provided with legal aid by the lawyer on duty, the case-handling unit shall allow and record it and transfer it with the case. However, the people's procuratorate shall notify the lawyer on duty to be present when signing the confession and repentance.
Legal basis: Article 3 of the Criminal Procedure Law of People's Republic of China (PRC) is responsible for the investigation, detention, execution and pre-trial of criminal cases. The people's procuratorate shall be responsible for the prosecution, approval of arrest, investigation and prosecution of cases directly accepted by procuratorial organs. The people's court is responsible for the trial. Except as otherwise specified by law, no other organ, organization or individual has the right to exercise these powers. In criminal proceedings, the people's courts, people's procuratorates and public security organs must strictly abide by the relevant provisions of this Law and other laws.
