During the trial, the attorney and the prosecutor cooperated with each other, exercised their appeal function according to law, and debated with the defendant and his defender. If the opinions of agency are inconsistent with those of public prosecution, the opinions of agency shall be expressed independently from the perspective of safeguarding the legitimate rights and interests of the victims. 7. If the victim and his legal representative refuse to accept the judgment of first instance, the attorney may, within five days after receiving the judgment, assist or represent the client and request the people's procuratorate to protest.

Article 34 of the Criminal Procedure Law: A criminal suspect has the right to entrust a defender from the day when he is interrogated for the first time by the investigation organ or takes compulsory measures. During the investigation, only lawyers can be entrusted as defenders. The defendant has the right to entrust a defender at any time.
