① This is determined by the current judicial situation in China and has its rationality. At present, the investigation methods and techniques of investigation organs in China are still relatively backward, and the detection of cases and the fixation of evidence also depend heavily on the confession of criminal suspects. The objective evidence of a large number of cases is that the criminal suspects confess first, and the investigators then fix the objective evidence according to the confession. If a lawyer is present during the whole interrogation of criminal suspects, although the rights of criminal suspects can be well protected, it is not conducive to investigation and evidence collection at the current level of judicial development.
2) At present, China's criminal evidence system respects and protects human rights more and more, resolutely excludes verbal evidence collected by illegal means such as extorting confessions by torture, and pays more and more attention to objective evidence. First of all, the two evidence regulations and the new criminal procedure law clearly stipulate that the interrogation process should be recorded or videotaped for cases that may be sentenced to life imprisonment, death penalty or other major crimes. This can guarantee the objectivity and authenticity of the interrogation record to the maximum extent. Secondly, the two evidence regulations and the new criminal procedure law clarify the exclusionary rules of illegal evidence, which resolutely exclude illegal verbal evidence and relatively exclude objective evidence. These two points reflect the remarkable progress made by China's criminal justice system in recent years.
3) From the perspective of judicial practice, more and more criminal suspects in zero confession cases have been sentenced to fixed-term imprisonment, which shows that our judicial organs are paying more and more attention to objective evidence, which is a good start and the criminal justice system will become more and more mature.
4) The Criminal Law Amendment (VIII) writes confession into the code as a light punishment circumstance, and clearly stipulates that criminal suspects with confession circumstances can be given a light punishment, which also encourages criminal suspects to truthfully confess their crimes.
5) To sum up, although the current criminal justice system in China does not give the criminal suspect the right to hire a lawyer on the spot, it also protects the human rights of the criminal suspect to a great extent and realizes judicial justice.
