State compensation includes attorney fees

Article 5: The state shall not be liable for compensation under any of the following circumstances:

(1) Personal behavior of administrative agency staff that has nothing to do with the exercise of their powers;

(2) Damage caused by the actions of citizens, legal persons and other organizations;

(3) Other circumstances stipulated by law.

Article 17 The state shall not be liable for compensation under any of the following circumstances:

(1) A citizen intentionally makes a false confession or forges other criminal evidence. Being detained or sentenced to a penalty;

(2) A person who is not criminally responsible in accordance with the provisions of Articles 14 and 15 of the Criminal Law is detained;

(3) ) A person who is not criminally responsible is detained in accordance with the provisions of Article 11 of the Criminal Procedure Law;

(4) Staff members of agencies that exercise investigation, prosecution, trial, prison management and other state functions and functions Personal behavior unrelated to official duties;

(5) Damage caused by citizens’ intentional self-injury or self-mutilation;

(6) Other circumstances stipulated by law.
