Being detained in criminal detention, under normal circumstances, the case-handling organ should have corresponding evidence to prove that a criminal fact has occurred and be able to lock the criminal suspect. In judicial practice, most criminal suspects should be arrested after being detained in criminal detention. Then it goes through three stages: investigation by public security organs, prosecution by procuratorate and trial by court. The court usually takes about five months to complete the trial.

Legal basis:
Article 80 of the Criminal Procedure Law, the public security organ may detain a flagrante delicto or a major suspect in any of the following circumstances:
(1) Being prepared to commit a crime, committing a crime or being discovered immediately after committing a crime;
(2) The victim or a witness on the spot identifies him as a criminal;
(3) criminal evidence is found around him or at his residence;
(four) attempted suicide, escape or escape after committing a crime;
(5) It is possible to destroy or forge evidence or collude with others;
(six) do not speak the real name and address, the identity is unknown;
(7) Being seriously suspected of committing crimes on the run, committing crimes for many times or committing crimes in association.
Article 293 of the Criminal Law shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance for any of the following acts:
(a) beating others at will, and the circumstances are bad;
(two) chasing, intercepting, insulting or intimidating others, and the circumstances are bad;
(three) extortion or arbitrary damage, occupation of public or private property, if the circumstances are serious;
(4) Causing serious disorder in public places.
Whoever gathers people for many times to commit the acts mentioned in the preceding paragraph and seriously undermines social order shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and may also be fined.
