Two, under what circumstances should be investigated for criminal responsibility?

3. More than 3 items (pieces) of state secrets at the secret level are disclosed;
4. The disclosure of state secrets to overseas institutions, organizations and personnel has caused or may cause harm or other serious harmful consequences to social stability, economic development and national defense security;
5. Disseminating or disseminating state secrets to the public by oral, written or online means;
6, the use of authority to instigate or force others to disclose state secrets in violation of the provisions of the state secrets law;
7. divulging state secrets for the purpose of seeking personal gain;
8. Other serious circumstances.
Third, the trial time of criminal cases.
The normal trial period of the court of first instance (generally 2 months, not more than 3 months at the latest, except in special circumstances)
208th Article When trying a case of public prosecution, the people's court shall pronounce a judgment within two months after accepting it, and no later than three months. For a case that may be sentenced to death or an incidental civil lawsuit, if one of the circumstances stipulated in Article 158 of this Law occurs, it may be extended for three months with the approval of the people's court at the next higher level; Due to special circumstances need to be extended, it shall be submitted to the Supreme People's Court for approval.
