First, the consequences of the losing party not paying the legal fees.
The consequence of the losing party's failure to pay the legal fees is that the court can enforce it. The litigation costs shall be borne by the losing party, and the Executive Board shall send a notice of paying the litigation costs to the losing party, informing it that it is obliged to pay the litigation costs of this case. Those who fail to fulfill this obligation need to bear certain legal responsibilities, such as paying fines, limiting their high consumption, being listed as untrustworthy or being detained. Therefore, the losing party should fulfill its obligation to pay legal fees in time.
Second, the standard of litigation costs
The charging standards for legal fees are as follows:
1. Property cases shall be paid in proportion between districts according to the amount or price claimed in the lawsuit. As a reminder, each item less than 10000 yuan should be sent to 50 yuan.
2. Divorce cases are charged on a case-by-case basis, with the total property of 50-300 yuan per piece not exceeding 200,000 yuan. The part of divorce cases exceeding 200,000 yuan is regarded as an intellectual property case, and the undisputed amount or price is 500- 1000 yuan.
4. Labor dispute case 10 yuan.
5. Trademark, patent, maritime 100 yuan, other administrative cases in 50 yuan.
6. Application publicity 100 yuan.
7. If the parties object to the jurisdiction of the case, and the objection is not established, they shall pay 50 yuan to 100 yuan for each piece.
3. Does the legal fee include the legal fee?
Legal fees do not include legal fees. If some contracts stipulate that the legal fees shall be borne by the losing party, you can claim the legal fees from the other party. According to the provisions of Article 6 of the Measures for Payment of Litigation Fees, litigation fees include case acceptance fees, application fees, and transportation, accommodation, living expenses and lost time subsidies incurred by witnesses, appraisers, translators and adjusters when they appear in court on the date designated by the court. Obviously, legal fees do not include legal fees. At the same time, the legal fees are charged by the court, while the lawyer's fees are charged by the lawyer (firm), so the legal fees cannot include the lawyer's fees.
