Sheriff of New Zealand
What is the function of a justice of the peace?
One: administrative functions? It is equivalent to the function of a notary in Chinese mainland, mainly notarizing copies of documents; Witness? Health certificate? 、? Power of attorney? The signature of such documents; Supervise the execution of some legal procedures for testifying and swearing; An approved sheriff can issue a police search warrant. All justices of the peace who have passed relevant training and assessment can perform administrative functions.
Two: judicial function? Responsible for hearing traffic accidents; Participate in civil mediation and trial of minor and non-malignant criminal cases and hear applications for detention and parole. Only a few justices of the peace who have passed judicial training and examination can perform judicial functions.
What documents need to be signed by justices of the peace?
First, when applying for New Zealand citizenship, that is, naturalization, you must ask the Justice of the Peace to notarize and sign the documents and photos. The procedure is: the applicant fills in the application form in advance and takes an oath in front of the justice of the peace to ensure that the contents of the document are true and correct before signing the application form. Some people sign their names at home, but when they arrive at the magistrate's court, they have to cross out their names and re-sign.
Second: When applying for a passport, you don't need to take an oath. The applicant can sign the application form directly. At this time, you don't need a justice of the peace. You need to find another person to do the applicant identification and sign the back of your passport photo.
Then, who can't give you the applicant identification? First, your relatives and family can't. Second, couples or cohabitants can't recognize each other. Third, people who live in the same address (such as landlords, tenants and roommates) can't agree with each other.
Who can identify the applicant for you?
A the certifier should have known the applicant 12 months or more (the certifier should have known and seen the baby since the baby was born).
B. The reference must be 16 years old or above.
C the reference should be able to provide the contact telephone number and answer the inquiries of the Ministry of the Interior during daytime office hours.
D the certifier should be willing to provide the Ministry of the Interior with the personal information required on page 1 1 of the application, and understand the corresponding legal responsibilities.
E. The reference must be a valid New Zealand passport or one of the eight persons listed on page 1 1 of the application form.
It is this article that often causes people's confusion. In other words, if the applicant can't find someone who meets the requirements of the first four articles and holds a New Zealand passport at the same time, he can find a lawyer (1), (2) a teacher, (3) a priest, (4) a policeman, (5) a Maori elder, (6) a registered doctor, a nurse and a pharmacist, who know more than1. What people often overlook is that even one of the eight kinds of people must know the applicant for more than 12 months before they can become an appraiser. What's the difference between using a passport to find an appraiser and using one of the eight kinds of people to find an appraiser? The difference lies in questions 42 and 43 on page 1 1 of the application form. If you are an authenticator other than eight people, you should provide your New Zealand passport number in the application form; The eight categories of people do not need to provide their own passport numbers, but only need to provide their names, contact addresses and telephone numbers.
Remind friends in China that page 1 1 of the application form should be filled in by the reference rather than the applicant. It is against the 1992 passport law to help others apply for a New Zealand passport with false and incorrect contents in New Zealand. Once found out, in addition to revoking the passport, the authenticator will be fined or imprisoned according to law. In China, all kinds of seals are recognized, while in New Zealand, personal signatures are legally binding. Therefore, before you sign any official document, you must know the contents of the document, and don't sign any document in the name of others without their consent. I hope that the descendants of the dragon with a history of 5,000 years of civilization will abide by the law in New Zealand, a country ruled by law, and work with other ethnic groups to jointly build and maintain this pure land paradise that we regard as our second hometown.
Third: when notarizing any copy of the document. Note: When notarizing documents, you must submit the original documents to the Justice of the Peace.
Fourth: any document that can be supervised, witnessed and signed by the justice of the peace.
Can the sheriff help arrange the personal naturalization oath?
In fact, there are two problems here, which are divided into two steps.
The first step is to apply in person. Some people can't attend the public sacrifice ceremony organized by the local municipal government for various reasons; Some elderly immigrants can't speak English, and the government provides them with the opportunity to take a separate oath of naturalization. Applicants, not justices of the peace, should directly contact the naturalization examination and approval officer according to their own circumstances, and the application examination and approval officer will decide whether to approve or not according to different circumstances. Once approved, the applicant will receive a letter and a personal naturalization arrangement form. The individual naturalization ceremony shall be held within 12 months from the date when the naturalization application is approved. The individual naturalization ceremony can be presided over by the following four kinds of people: (1) justices of the peace (2) barristers of the High Court (3) members of parliament (4) authorized officials of the Ministry of the Interior.
Step two, the applicant can find a justice of the peace who is willing to preside over the naturalization oath ceremony for you and fill in the timetable of personal naturalization ceremony sent by the Ministry of the Interior. The Ministry of the Interior will issue the citizen certificate to the sheriff who presided over the ceremony before the ceremony date agreed by you and the sheriff. Under the supervision of the Justice of the Peace, the applicant swore to abide by the laws of New Zealand, safeguard the national interests of New Zealand and be loyal to the Queen of England. Then accept the certificate of New Zealand citizenship issued by the Justice of the Peace on behalf of the country.
Naturalization is a serious event in life. It is also a rare life experience to take the oath with people of different races from all over the world, accept the welcome and congratulations from the representatives of the city, accept the citizenship certificate in front of hundreds of people, and become a member of the country of your choice. Therefore, if there are no special difficulties, you should still participate in the collective naturalization oath ceremony organized by the municipal government.
Where can I find the sheriff?
First of all, all the citizens' advisory offices in Auckland have the normal working hours of the sheriff. You can also go to the nearest citizen consultation bureau where you live.
Secondly, you can look up JPs in the phone book under the prefix J (between pages 1460 and 1467 of the yellow pages phone book in 2007), find a JP who is closest to home and arrange a meeting. If you don't know English, I believe you can find a sheriff who speaks the same language as you from the spelling of your last name.
In New Zealand, the sheriff provides free services to the public in his spare time without any government subsidies or benefits. Some on-the-job employees have to balance family life and serving the community. I hope everyone understands and cooperates. When you need the service of the justice of the peace, you must make an appointment in advance, negotiate the service time and try to avoid calling before 8: 00 a.m. and after 9: 00 p.m. so as not to disturb your family life.
Can justices of the peace answer legal questions?
Although justices of the peace belong to New Zealand's judicial system, they must pass the training and examination of basic legal knowledge before performing their duties as justices of the peace, but that is not systematic legal knowledge training. Therefore, if you have legal problems, you should consult a lawyer. Citizens' advisory offices in various regions also have free legal consultation time. I suggest you contact them and make an appointment for an interview. At present, the difficulty is that few China lawyers provide free legal consultation services in the Citizens' Advisory Bureau. I hope that as more and more China people enter the society after completing their legal studies, we can also see the figure of lawyer China in the Citizen Consultation Bureau.
