The central bank's credit information system incorporated the overdue repayment records of credit cards into the credit information system to generate bad credit records. China has established a national credit information sharing network. Individual residents can check the credit report in any domestic commercial bank as long as they apply for a credit card at the bank or provide a guarantee for others.

If the credit card is not repaid within 3 months, the bank will send a lawyer's letter to the user and bring a lawsuit to the court, and the expenses will be borne by the cardholder.
5. Criminal responsibility for malicious overdraft.
According to Article 196 of the Criminal Law and relevant judicial interpretations, malicious overdraft refers to the behavior of the cardholder who overdraws within the prescribed limit or time limit for the purpose of illegal possession, and still refuses to return it after collection. Those who maliciously overdraw and commit credit card fraud, if the circumstances are serious enough to constitute a crime, shall be investigated for criminal responsibility according to law, and may be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan.
