Can I drop the case if I file a case?

The trial principles of criminal cases and civil cases are inconsistent. The principle of non-litigation and indifference is adopted in civil cases, that is, if the plaintiff does not appear in court, the people's court will not take the initiative to hear it. Once a criminal case occurs, the public security organ will file a case for investigation. Unless the suspect does not constitute a crime after investigation, the case will not be revoked because of the victim's application.

After a criminal case is filed, whether the parties can withdraw the case mainly depends on the type of case and the circumstances of the crime. If it is a public prosecution case, the parties cannot withdraw the lawsuit.

The law provides that:

Article 16 of the Criminal Procedure Law

In any of the following circumstances, criminal responsibility shall not be investigated, and if it has been investigated, the case shall be dismissed, or prosecution shall not be initiated, or the trial shall be terminated, or the case shall be declared innocent:

(a) if the circumstances are obviously minor and the harm is not great, it is not considered a crime;

(two) the crime has passed the limitation period;

(3) Being exempted from punishment by an amnesty order;

(four) in accordance with the "Criminal Law" to inform the handling of the crime, not to inform or withdraw;

(5) The criminal suspect or defendant dies;

(six) other laws and regulations shall be exempted from criminal responsibility.
