In order to maintain the prosperity and stability of Hong Kong and Macao, safeguard the legitimate rights and interests of mainland residents going to Hong Kong and Macao, further standardize the examination and approval of settling in Hong Kong and Macao, and maintain the normal entry and exit order; At the same time, in order to improve the transparency of the examination and approval of settling in Hong Kong and Macao, and promote the construction of an honest and diligent administration of the exit-entry administration departments, this Code is formulated in accordance with the relevant provisions of the Interim Measures for the Administration of China Citizens' Private Travel between Hong Kong and Macao (hereinafter referred to as the Interim Measures).
I. Conditions for settling in Hong Kong and Macao
According to the provisions of the Interim Administrative Measures, those who meet one of the following circumstances may apply to settle in Hong Kong and Macao:
(1) One of the spouses has settled in Hong Kong or Macao and has been separated for many years;
(2) Parents who have settled in Hong Kong and Macao are old and infirm and must be taken care of by mainland children;
(three) the elderly and children who are helpless in the mainland have to rely on their immediate family members and close relatives in Hong Kong and Macao;
(four) the immediate family members who have settled in Hong Kong and Macao have no inheritance, and they must be inherited by the children who have settled in the Mainland;
(five) there are other special circumstances that must be settled in Hong Kong and Macao.
The applicant in the first paragraph of the preceding paragraph must have a legal marriage relationship with Hong Kong and Macao residents; If you are approved to settle in Hong Kong and Macao, you can bring a child under the age of 14.
The second paragraph, the applicant must be 18 years old and under 60 years old; Both parents must be over 60 years old, and one or both of them have settled in Hong Kong and Macao and have no children to take care of them.
The "elderly" in the third paragraph refers to mainland residents who have reached the age of 60 and whose children have not settled in the mainland and are left unattended; "Children" refers to mainland residents under the age of 14 whose parents have not settled in the mainland or whose parents are both dead.
The fourth paragraph refers to Hong Kong and Macao residents who have no immediate family members around them and need mainland children to settle in Hong Kong and Macao to inherit the industry after their death. If many people share the right of inheritance, only one person will be accepted to settle in Hong Kong and Macao and inherit the inheritance.
The fifth paragraph refers to those who really need to settle in Hong Kong and Macao for special reasons.
The above-mentioned "immediate family members" refer to father, mother, son, daughter, (foreign) grandparents and (foreign) grandchildren; "Close relatives" refer to brothers and sisters.
Two. Procedures to be performed by the applicant
When applying to the exit-entry administration department of the public security bureau of the city or county where the household registration is located, the applicant shall answer relevant inquiries and perform the following procedures:
(1) Submit the Examination and Approval Form for Mainland Residents to Settle in Hong Kong and Macao (see Annex 1 for the format) in duplicate and two photos identical to the application form, which are completely filled in and affixed with the applicant's recent bareheaded color photos (specifications are 32x40mm);
(two) submit the identity card and residence booklet or other household registration certificate;
(3) Submit certificates corresponding to the reasons for settling in Hong Kong and Macao;
(4) Invitations from relatives of Hong Kong and Macao;
(five) the opinions of the applicant's unit or the public security police station on the applicant's settlement in Hong Kong and Macao;
(6) Other certificates deemed necessary by the examination and approval authority.
Three, to settle in Hong Kong and Macao, the corresponding certificate refers to:
(a) to apply for the reunion of husband and wife who have settled in Hong Kong and Macao, a marriage certificate and a Hong Kong (Macao) resident identity card of the spouse who has settled in Hong Kong and Macao shall be submitted.
(two) to apply for settlement in Hong Kong and Macao to take care of the elderly and infirm parents in Hong Kong and Macao, submit the parents' childless certificate, proof of kinship, and my Hong Kong (Macao) resident identity card and home visit certificate of Hong Kong and Macao compatriots.
(three) to apply for residence in Hong Kong and Macao and to rely on their parents to support their children in the mainland, they must submit birth medical certificates, parents' marriage certificates, parents' Hong Kong (Macao) resident identity cards and Hong Kong and Macao compatriots' home visit certificates; Orphans who apply to settle in Hong Kong and Macao and take refuge in their relatives need to produce a household registration book with their parents dead, a certificate of kinship with the trusted person, a Hong Kong (Macao) resident identity card of the trusted person and a home visit permit for Hong Kong and Macao compatriots; Children who take refuge in adoptive parents also need to issue proof of legal adoption relationship; If parents divorce, they need to issue a divorce judgment that the father or mother has custody over them as determined by the court.
(4) Mainland elderly people who apply to settle in Hong Kong and Macao and take refuge with their relatives in Hong Kong and Macao need to submit materials that can prove that they have no children in the Mainland and that their relatives have no children, as well as their Hong Kong (Macao) resident identity cards and Hong Kong and Macao compatriots' home visit cards.
(five) to apply for living in Hong Kong and Macao to inherit the estate, it is necessary to provide the death certificate of the decedent, the certificate that there is no heir in Hong Kong and Macao, the certificate of the applicant's inheritance right, the legal documents issued by the Hong Kong and Macao heritage management authorities and the certificate of paying the inheritance tax.
The residents of Hong Kong and Huanan mentioned in the above five paragraphs are of foreign nationality, and they need to show their foreign passports or other documents that can prove their foreign nationality, Hong Kong and Macao permanent resident identity cards and proof of kinship. If the items in the Application Form for Settlement in Hong Kong and Macao and the matters proved by the submitted materials change with time, the applicant shall promptly report to the public security organ that accepted the application and submit the corresponding certificates.
Four, the applicant's unit or police station to prove that the applicant has settled in Hong Kong and Macao.
The opinions of the applicant's unit or police station on the applicant's settlement in Hong Kong and Macao shall be directly filled in the corresponding column of the application form and stamped with the official seal. The examination opinions shall include: whether the contents filled in the application form are true and whether the applicant has "Chinese".
The Law on the Administration of Exit and Entry of Citizens of China City, People's Republic of China (PRC) stipulates five situations in which they are not allowed to leave the country, and whether the applicant is allowed to leave the country. Do not meet, it shall explain the reasons. The units responsible for issuing opinions to the applicant are:
(a) public officials, by the personnel organization department according to the cadre management authority issued opinions;

(a) to receive an application form for settlement in Hong Kong and Macao. According to the provisions of Article 1 of this Code, all localities have formulated and applied for the Approval Form for Mainland Residents to Settle in Hong Kong and Macao. According to local regulations, mainland residents should go to the place where their household registration is located.
City and county public security organs receive the Application Form for Mainland Residents to Settle in Hong Kong and Macao. Fill in the application form, submit the relevant certification materials specified in Article 3 of this Code, and apply to the public security organ for settlement in Hong Kong and Macao.
(2) Examining the applicant's certification materials. After accepting the application, the county or municipal public security bureau or public security bureau shall carefully examine and investigate the reasons for the application and the corresponding materials, and after signing the consent or disagreement, report it to the exit-entry administration department at a higher level for examination and approval. It should be completed within 60 days from accepting the application to making a decision of approval or disapproval and notifying the applicant. (3) Queue up and announce the results. The exit-entry administration department of the public security organ shall grade the mainland residents who are allowed to settle in Hong Kong and Macao according to the grading standard (see Annex 3), queue up in turn according to the grading level, and announce the queuing situation.
(4) Publish the certification list. The exit-entry administration department of the public security organ shall, according to the limited places and in the order of queuing, publish the list of people released to settle in Hong Kong and Macao every month. 15 before the issuing date, the applicant's name, gender, date of birth, work unit, home address, reasons for settling in Hong Kong and Macao, years of separation, etc. It will be posted at the police station where the applicant's household registration is located and the reception room of the entry-exit administration department that initially accepted the applicant's application, and will be supervised by the masses.

The exit-entry administrative department of public security should take seriously the objections or reports raised by the masses.
