Su Dong: Learn all the legal provisions, clearly understand the demands of customers, and strive for the greatest rights and interests for customers within the scope permitted by law. But this is only the premise. More importantly, a good lawyer should balance the relationship between the law and the rights and interests of the parties, which is a moral requirement and judgment for a lawyer. The most important thing for a good lawyer is to safeguard the fairness and justice of the whole society. He is not only a complete interest seeker.
Bei Lao: In your opinion, I am a lawyer who broke through the bottom line of conscience and morality and was kidnapped by interests. I don't have the heart of fairness and justice, but I am familiar with the law and use it to sue.
Law is a rational clause, which restricts people's behavior one by one, and its purpose is to protect the lowest moral bottom line of human beings. Whoever breaks through will pay the price.
Then people who are engaged in the profession of lawyers should be people with conscience and rational practice. But who can tell me, is there a paradox behind all these laws? That is to say, from a legal point of view, isn't there only one standard to judge the same thing? But our experience tells us that this is not the case. If so, it doesn't matter whether we win or lose between lawyers. Then why?
Because the cold and rigid law is not bound by rational and deliberate standards, it should be full of hope and the induced desire of human moral conscience.
Therefore, I believe that the best lawyers are not only messengers who practice social fairness and justice, because we can enthusiastically interpret the good wishes of mankind through one case at hand. At the same time, it leads the cold method to be more humanized and more in line with today's moral standards. In this sense, we should be romantic idealists, because we seek the greatest common denominator of harmony in all social contradictions. At the same time, we are rational pragmatists, because we are pursuing the greatest rights and interests of all parties to the contradiction. Furthermore, we are self-sufficient builders who pursue fairness and morality.
I was the first practicing lawyer in the early 1980s, that is, after the reform and opening up. Witnessed the difficult and painful growth of the lawyer profession in the complicated development.
You must admit that sometimes you fight for fairness, but in the end you get compromised fairness. For justice, we put up with humiliation and even sacrificed ourselves, but in the end we got partial justice. From a perfectionist's point of view, that's called failure. But from a realist point of view, this is called success and progress. Because we are human beings, not gods. We are eating whole grains, seeking pure truth in a chaotic world and striving for flawless beauty. It's like pulling out our hair, so we struggle, suffer, and even go crazy. Because I always tell myself that a moral guardian has a kind heart and good wishes. But later I learned that from the day I became a lawyer, I was a victim and a martyr. I will definitely pay the price and get more important results in the world.
Please believe that I didn't exchange money and status. I know my confession today is useless to you. But what I hope to see more is that one day in the next twenty years, you will sum up your life like me. The students in your audience also ridicule your confession, which is inheritance.
In fact, for us, the law is not only used to judge and enforce the judgment of human disputes, but also to safeguard social fairness and justice with the sacrifice of a lifetime and a generation. This kind of sacrifice is not physical, nor is it limited to spiritual. Instead, we sacrificed all our original ideals and self-denied our favorite principles in exchange for the improvement and progress of human civilization and law from the life we started as a teenager to the moment when we finally went to court.
Especially today, the day I say goodbye, I can proudly say that I am a qualified lawyer, because in these thirty years, I have worked hard, compromised and sacrificed, and I have seen the law in China come to this day. At the same time, it is even more gratifying that generation after generation, I see your generation mocking our generation, and at the same time, you are moving on. Bless you, young people. I wish you the purity of your ideal and the persistence of your ideal.
