3. Whether the infringer has false elements in the publicity process; Even if the content of this propaganda is true, if "mixed propaganda" is enough to mislead the public and make a wrong judgment;
4. Whether the consequences of "false propaganda" and "misleading propaganda" have harmed the rights and interests of consumers or competitors; Whether it is enough to increase the competitive advantage of the infringer, so that he can get more market trading opportunities, thus damaging the normal market competition order, and then conforming to the legal provisions of "violating recognized business ethics and disturbing the normal competition order", constitutes unfair competition behavior.
