A criminal indictment is composed of three parts: head, body and tail. The first part should state: (1) The name of the document, that is, "Criminal Complaint with Civil Complaint"; (2) The name, gender, date of birth, nationality, place of birth, education level, occupation, or Work unit, position, address. The main text should state: (1) claim; (2) facts and reasons; (3) evidence to prove loss, etc. The request shall state the items and specific amounts of compensation received by the defendant in the attached civil lawsuit. The facts should state the actual economic losses caused to the victim and the plaintiff in the incidental civil action due to the criminal behavior of the defendant in the incidental civil action. Reasons should be given as to why the defendant in the incidental civil lawsuit should bear civil liability according to relevant legal provisions. Evidence proving loss should itemize the name, type and source. At the end: (1) The name of the people's court; (2) The number of copies of the attached civil complaint; (3) The signature or seal of the plaintiff in the civil lawsuit; (4) The creation time. Since the incidental civil action was filed during the course of the criminal proceedings, the prosecutor's office has already initiated a public prosecution for the crime. Therefore, criminal litigation should focus on the material losses caused to the victim by the defendant's criminal behavior and relevant evidence.

Article 141 of the Supreme People's Court's "Applicable Interpretation": After the People's Court accepts a criminal case, it complies with Article 99 of the Criminal Procedure Law and As stipulated in Paragraph 1 of Article 138 of this Interpretation, the victim or his legal representative or close relatives may be informed of the right to file an incidental civil lawsuit. If a person who has the right to initiate an incidental civil lawsuit waives his right to litigate, permission shall be granted and the case shall be filed. Article 162 of the "Interpretation of the Supreme People's Court on Application" The People's Court shall not charge litigation fees when hearing criminal incidental civil litigation cases.
