Acceptance and Preparation Procedures for Incidental Civil Litigation
After receiving the incidental civil complaint, the people's court shall conduct a review and decide within 7 days whether to file the case. If the legal conditions are met, the case shall be accepted; if the requirements are not met, the prosecution shall be dismissed.
After the people's court accepts the incidental civil action, it shall serve a copy of the incidental civil complaint to the incidental civil action defendant within 5 days, or promptly inform the incidental civil action defendant of the content of the oral complaint and make a transcript. . If the defendant is a minor, a copy of the attached civil complaint shall be served on his legal representative, or his legal representative shall be informed of the contents of the oral complaint. When the people's court serves a copy of the attached civil complaint, it shall determine the time for the defendant or his legal representative to submit a civil reply based on the time limit for hearing the criminal case.
