Can an economic dispute be dismissed after it is filed?

Legal analysis: Whether the case can be dismissed depends on whether the economic dispute involves a criminal case.

Criminal economic cases are generally public prosecution cases. Under normal circumstances, public security organs will not drop the case after filing a case. However, if the statutory conditions are met, the investigation organ will also make a decision not to file a case, such as the circumstances are obviously minor, the harm is not great, it is not considered a crime, the crime has passed the limitation period of prosecution, or it is exempted from punishment by Amnesty.

If it is only an economic case and does not involve any criminal case, the lawsuit can be withdrawn, and the plaintiff can also withdraw the lawsuit to the court if he wants to.

Legal basis: Article 16 of the Criminal Procedure Law of People's Republic of China (PRC) shall not be investigated for criminal responsibility under any of the following circumstances. If the investigation has been concluded, the case shall be dismissed, or no prosecution shall be instituted, or the trial shall be terminated or acquitted:

(a) if the circumstances are obviously minor and the harm is not great, it is not considered a crime;

(two) the crime has passed the limitation period;

(3) Being exempted from punishment by an amnesty order;

(4) Failing to tell or withdrawing a crime that should be dealt with only after being told according to the Criminal Law;

(5) The criminal suspect or defendant dies;

(six) other laws and regulations shall be exempted from criminal responsibility.

Before the verdict is pronounced in Article 145 of the Civil Procedure Law of People's Republic of China (PRC), if the plaintiff applies for withdrawing the lawsuit, the people's court shall decide whether to grant it or not. The people's court has ruled that the withdrawal of the lawsuit is not allowed, and if the plaintiff refuses to appear in court without justifiable reasons after being summoned, the judgment may be made by default.
