Legal analysis
The appraisal results of judicial authentication institutions generally have legal effect. Especially when it comes to criminal cases, if the judicial expertise can't guarantee the authority of the results, it can't guarantee the fairness of the judicial trial. However, for the parties concerned, if they disagree that the appraisal result does not conform to the relevant provisions, they may also request re-appraisal. In order to ensure the effectiveness of re-appraisal, the appraisal rules stipulate that the qualification conditions of the judicial authentication institutions entrusted by re-appraisal should generally be higher than those entrusted by the original judicial authentication institutions. Re-authentication shall be entrusted to other judicial authentication institutions listed in the roster of judicial authentication institutions other than the original authentication institutions; If the client agrees, it may also entrust the original judicial authentication institution to designate other qualified judicial authenticators other than the original judicial authenticators. For the identification matters involving major cases or encountering particularly complicated, difficult and special technical problems, the competent department of judicial authentication or the professional organization of judicial authentication may, upon the entrustment of the judicial organ or with the consent of the judicial organ, organize a number of judicial authentication institutions to carry out the identification.
