First of all, the most common dangerous driving offense is driving a motor vehicle while drunk. According to relevant laws and regulations, driving a motor vehicle with a blood alcohol content of 80 mg/100 ml or more on the road is considered drunk driving and will be convicted and punished for dangerous driving in accordance with the provisions of Paragraph 1 of Criminal Law 133.
Secondly, if one of the following circumstances occurs: (1) causing a traffic accident, taking full or major responsibility for the accident, or causing a traffic accident and then escaping, which does not constitute other crimes; (2) the alcohol content in the blood reaches 200 mg/100 ml or more (3) Driving on highways and urban expressways (4) Driving a commercial motor vehicle carrying passengers (5) Seriously overcrowded. Driving a motor vehicle without driving qualifications, using forged or altered motor vehicle license plates, and other serious violations of the Traffic Safety Law (6) Evading the lawful inspection by the public security organs, or refusing or obstructing the lawful inspection by the public security organs, which does not constitute other crimes (7 ) who has been subject to administrative penalties or criminal prosecution for driving a motor vehicle after drinking alcohol shall be severely punished in accordance with the provisions of paragraph 1 of Criminal Law 133.
Finally, my country’s crackdown on dangerous driving is relatively strong, and the legal provisions and judicial interpretations of dangerous driving crimes are very complicated. It is recommended that the parties concerned can still entrust a professional criminal lawyer to handle the matter.
Legal Basis
Criminal Law Article 133-1: The crime of dangerous driving. Anyone who drives a motor vehicle on the road under any of the following circumstances shall be sentenced to criminal detention and shall also be fined:
(1) Chasing and racing with serious circumstances;
(2) Driving a motor vehicle while drunk;
(3) Engaging in school bus business or passenger transport, Seriously exceeding the rated number of passengers or driving at a speed that exceeds the prescribed speed;
(4) Transporting hazardous chemicals in violation of the safety management regulations for hazardous chemicals and endangering public safety.
Motor vehicle owners and managers who are directly responsible for the acts in Items 3 and 4 of the preceding paragraph shall be punished in accordance with the provisions of the preceding paragraph.
Those who commit the acts in the preceding two paragraphs and constitute other crimes at the same time shall be convicted and punished in accordance with the provisions of heavier penalties.
