Can family members secretly record the trial?

I can't. No audio-recording, video-recording, photo-taking or mobile communication tools shall be used to spread the trial activities. It is a citizen's right to attend the trial. All citizens who have reached the age of 18 have the right to participate in the trial in public, but citizens must abide by the rules of the trial, otherwise they may face the risk of warning, admonition, fine, detention or even criminal responsibility.

Article 17 In court trial activities, all personnel shall obey the command of the presiding judge or the sole judge, respect judicial etiquette and observe court discipline, and shall not commit any of the following acts:

(1) Clap and make noise;

(2) smoking and eating;

(3) make or answer the phone;

(4) Recording, video recording, taking photos or using mobile communication tools to spread the trial activities;

(five) other acts that endanger the security of the court or disturb the order of the court.

Prosecutors and participants in litigation may speak or ask questions with the permission of the presiding judge or the sole judge.

Observers are not allowed to enter the trial activity area, stand or walk around at will, or speak or ask questions.

Media reporters who are allowed to carry out the acts in Item 4 of Paragraph 1 shall do so at the designated time and area, and shall not affect or interfere with the trial activities.

Article 10 The people's court shall provide convenience for the parties, their defense lawyers and agents ad litem. Access to trial audio and video recordings according to law through convenient litigation service platforms such as trial process information disclosure platform and litigation service platform.

The people's court shall take necessary security measures for audio and video materials for inspection.

Eleventh parties, defense lawyers, agents ad litem, etc. The audio and video recordings of the trial may be copied or transcribed in accordance with the provisions, and the people's court shall be equipped with corresponding facilities when necessary.
