The situation of the bailed person needs to be evaluated. The risk of bail pending trial is that if the suspect makes a mistake during bail pending trial, he needs to bear corresponding legal responsibilities. If the guarantor is required to assume that the guarantor will not escape in the bail pending trial area, and the criminal suspect meets the conditions of bail pending trial, the public security organ, the people's procuratorate and the people's court shall order the criminal suspect and the defendant to propose a guarantor or pay a deposit.
The conditions for bail are:
1. The criminal suspect or defendant may be sentenced to public surveillance, criminal detention or independent application of supplementary punishment according to law;
2. A woman who may be sentenced to fixed-term imprisonment or above, or a woman who is seriously ill, unable to take care of herself, pregnant or nursing her own baby, will not cause social danger if she is released on bail pending trial;
3, the detention period expires, the case has not yet been settled, and it is necessary to get a bail pending trial.
To sum up, helping others will generally have no impact on yourself; However, if the guarantor violates the law and the guarantor fails to perform the guarantee obligations, the relevant departments will impose a fine on the guarantor, and if the case constitutes a crime, criminal responsibility will be investigated according to law.
Legal basis:
Article 70 of the Criminal Procedure Law of People's Republic of China (PRC)
The guarantor shall perform the following obligations:
(1) To supervise the warrantee to abide by the provisions of Article 71 of this Law.
(2) If it is discovered that the warrantee may or has violated the provisions of Article 71 of this Law, it shall promptly report to the executing organ.
If the warrantee violates the provisions of Article 71 of this Law and the guarantor fails to perform his guarantee obligations, he shall be fined, and if the case constitutes a crime, he shall be investigated for criminal responsibility according to law.
Article 67
The people's courts, people's procuratorates and public security organs may obtain a guarantor pending trial for a criminal suspect or defendant under any of the following circumstances:
(a) may be sentenced to public surveillance, criminal detention or independent application of supplementary punishment;
(two) may be sentenced to more than fixed-term imprisonment, bail will not cause social danger;
(3) A woman who is seriously ill, unable to take care of herself, pregnant or breast-feeding her baby is released on bail pending trial, which will not cause social danger;
(four) the detention period expires, the case has not yet been settled, and it is necessary to get a bail pending trial.
Bail pending trial shall be executed by the public security organ.
