What kind of document is the procuratorial organ’s case filing decision?

The procuratorial organ's case filing decision is a blank document in a standardized format.

The instructions for making the filing decision are as follows:

1. According to Article 18, Paragraph 2, Article 83, Article 86 and "Criminal Procedure Law" Article 133 of the Criminal Procedure Rules of the People's Procuratorate, this instrument is formulated. Used by the Attorney General when deciding to open an investigation.

2. For crimes of corruption and bribery, crimes of dereliction of duty by state functionaries, crimes of infringement of citizens’ personal rights, and crimes of state functionaries taking advantage of their powers to infringe on citizens’ democratic rights, Articles 83 and 8 of the Criminal Procedure Law shall apply Article 16. If the People's Procuratorate at or above the provincial level decides to directly accept other major criminal cases committed by state agency staff using their powers, Article 18, paragraph 2, Article 83, and Article 86 of the Criminal Procedure Law shall be cited.

3. * * * *For joint crime cases, the names of all criminal suspects should be filled in. When filing cases on a case-by-case basis, the basic information of the criminal suspect is not filled in. When produced, it shall be signed or stamped by the chief prosecutor, and the seal of the People's Procuratorate on which the case is filed shall be affixed.

5. This document is made in duplicate. The first copy is retained for future reference and the second copy is attached.
