Criminal lawyers under the new criminal procedure law

When meeting with detainees, they should hold valid identity documents. When the lawyer entrusted by the detainee meets with the detainee, he shall also hold a lawyer's practice certificate, a certificate of law firm, a power of attorney or a letter of legal aid. The police of the detention center shall examine the relevant certificates and vouchers of the meeting personnel, fill in the registration form of meeting the detainees, and make arrangements in time. Meeting with detainees shall be conducted at the time and place specified by the detention center, and the regulations on meeting with detainees shall be observed. Analysis of lawyers' harbor: Generally, the number of meetings with detainees should not exceed 2 times, the number of people meeting each time should not exceed 3, and the meeting time should not exceed 30 minutes. If there are special circumstances that require a meeting on a non-meeting day or increase the number, number and time of meetings, it must be approved by the leaders of the detention center. A detention center shall detain a detainee by legal documents such as administrative punishment decision, detention decision of the people's court, detention review decision, detention restoration decision, detention and repatriation decision or judgment issued by the organ that made the detention decision or judgment (hereinafter referred to as the detention decision organ). In case of detention in a different place, the detention center shall take the detainee into custody on the basis of the detention decision document of the detention decision organ, the written explanation of the need for detention in a different place and the approval procedures of the public security organ in charge of the detention center.

Where a detention center detains a detainee temporarily by a case-handling organ in a different place, it shall be detained with the approval of the public security organ in charge of the detention center and the legal documents of the detention decision organ or other relevant detention certificates. Temporary storage time is generally not more than 3 days.
