Before paying the fine, you can contact the competent judge first; You can also directly hold the judgment and pay the fine at the court's legal fee payment window.
According to the provisions of the Criminal Procedure Law and the Criminal Law, the fines imposed by the court shall be paid within the time stipulated in the judgment; If you still don't pay after the expiration, you will be forced to pay by the court.
First, the characteristics of fines
(1) Fines, like confiscation of property, are compulsory property punishment measures taken by the people's courts against criminals.
(2) According to the principle of "committing a crime by yourself, being responsible for it, and opposing implicating others" in China's criminal law, fines, like confiscation of property, can only execute all the property of criminals, but not all the property of criminals' families or later.
(3) The scope of fines can only be to force criminals to pay a certain amount of money owned by individuals. If there is no money, measures can be taken to seal up, detain, freeze, sell or auction all their legal property, and the proceeds from the sale or auction can be used to offset the fine.
(4) The payment of the fine is related to the execution of the penalty after the court decision takes effect.
Second, the application of fines
According to the criminal law of China, fines can be applied in the following four ways:
1. Single family type. Single subject fine stipulated in criminal law is mainly applicable to unit crime. For example, the unit bribery crime stipulated in Article 387 of the Criminal Law and the unit bribery crime stipulated in Article 393 of the Criminal Law impose a fine on the unit. In this case, the fine can only be applied separately.
2. Select the theme type. In the case of applying the fine penalty alone, the criminal law stipulates that the fine penalty is juxtaposed with other punishments and can be applied selectively. For example, according to Article 275 of the Criminal Law, whoever commits the crime of intentionally destroying property shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or a fine. In this case, the fine, as an optional legal punishment, can only be applied separately, not in addition.
3. Parallel style. In the case of additional fine penalty, it is clearly stipulated that a fine must be imposed at the same time when a penalty of freedom is imposed. For example, the crime of reselling cultural relics as stipulated in Article 326 of the Criminal Law shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and fined; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than five years and fined. Here, fines can only be applied in addition, not separately.
4. compound type. Compound refers to the provision of a single fine and a fine in a law for optional application. For example, Article 2 16 of the Criminal Law stipulates that whoever counterfeits another person's patent, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also or only be fined. In this case, the fine can be applied in addition or separately, and it is decided whether to apply it jointly or separately according to the seriousness of the crime committed by the criminal.
