After all, there are not many such internship opportunities. In my previous internship, I had many shortcomings exposed. I think I will correct these shortcomings and make greater progress in this internship. I have been working hard in the past, and I have been working hard as always in this internship. I have made great progress, as long as I keep working hard!
This summer vacation, I was lucky enough to practice in the Public Prosecution Section of the County People's Procuratorate for more than a month, and I devoted myself to political and legal work as an assistant prosecutor. On the one hand, I hope to have a perceptual and objective understanding of the theoretical knowledge I learned during my college years through practice, on the other hand, I hope to improve my interpersonal skills and cognitive ability to society. For more than a month, my teacher and I have done a lot of work: making examination opinions, interrogating criminal suspects, writing public prosecution opinions and indictments, and appearing in court to support public prosecution. I also learned a lot from it:
First, the production of review opinions
Almost every student who comes to practice in the public security law department, the first thing to do is to put forward the review opinions. This job is simple and simple, complicated and complicated. Personal feelings test a person's patience and carefulness. It's very simple, because these cases were handed over by the public security organs, and some tedious work was done by them. It is complicated because the public security organs have to deal with many cases every day, and there may be some negligence. At this time, it is necessary to test a prosecutor's care and patience, and find bones in eggs.
The first case I participated in the review was theft. I heard from Mr. Shen that the most cases they handle are theft, and now the means of theft are being refurbished day by day. I spent more than two hours reading the document first. The main contents of the file involve the interrogation record of the suspect, the interrogation record of the victim, relevant material evidence and witness testimony, etc. I have a detailed understanding of his motive, means of committing crimes, the amount involved and the process of solving crimes by public security organs. I can conclude that he constitutes theft. Then I operated on the spot, found a stolen template and made an audit opinion on it. I found this to be the most important one. Every piece of evidence on which the verdict is based has been verified, and the evidence is legal and valid. There is an objective correlation between the evidence on which the final decision is based and the facts proved. The ultimate goal is to say that the evidence on which the case is finalized can lead to the only exclusive conclusion: the suspect committed theft.
About an hour later, a complete review opinion was completed, and I took it to Mr. Shen for inspection. Mr. Shen asked me to print it out after reading it, and I knew it was successful. There have been a lot of reviews this month, and I can't remember exactly how many. Anyway, there are all kinds of messy cases, one is more bizarre than the other, and the other is even more staggering ... Through piles of files, I feel the boring legal provisions in the textbook for the first time, and all kinds of bizarre cases told by teachers are so close to us. I really regret not studying hard in class. I hate when books are used.
Second, appear in court to support public prosecution.
Some time before the trial, the procuratorate will receive a notice to appear in court, and then the prosecutor will make preparations before the trial, including the outline of the debate and the public prosecution. On the day of the trial, because I didn't have a work permit, I didn't appear as a prosecutor to support the public prosecution. Teacher Shen asked me to sit under the stage. I found that the public prosecutor's image in the court was even bigger, especially when the public prosecutor read the indictment and expressed his opinions on public prosecution. I found that it was not after the case was handed over to the court that the prosecutor was waiting for trial. In fact, before appearing in court to support the public prosecution, the prosecutor must further review the evidence and be familiar with the case. It should be said that when the case is prosecuted, the prosecutors have a profound understanding of the case. However, due to the distance between prosecution and trial, prosecutors often undertake several different cases at the same time, and it is easy to forget some key plots, so it is necessary to further review the prosecution evidence before the trial. At the same time, we should be more familiar with the case and analyze the possible excuses put forward by the defendant and his defenders, so as to use the evidence flexibly and freely in the trial, refute the unreasonable excuses of the defendant and his defenders in time, deal with all kinds of emergencies, effectively expose and prove the crime, and fully exercise the right to support the public prosecution in court.
Three. Summon a criminal suspect
In fact, what I did most during my internship was to go to the detention center with the prosecutor to interrogate the suspect, and I learned a lot every time I tried. I clearly remember my first time. When I first entered the detention center, I was full of curiosity and kept watching. But when facing the suspect, I really sat there quietly, burying my head in taking notes, and didn't dare to look at the suspect at all. This was discovered by teacher Shen. On the way back, Mr. Shen told me that the next time I came back, I must look up at the suspect. In front of criminal suspects, you are not an intern, but a prosecutor. Then I thought about it myself. Yes, the suspect didn't know I was an intern. If I keep taking notes, what impression will he have? ! Today, this "prosecutor" looks naive and has no dignity at all. How can he be a national staff member? In front of the criminal suspect, I represent the prosecutor and the image of the whole procuratorate.
Second:
During the winter vacation, I went to the Public Prosecution Section of Huicheng District People's Procuratorate for internship, and the time was 65438+ 10/8 to February 1. This internship has given me a lot of exercise and broadened my horizons. Through practice, I learned about the working process of the Public Prosecution Section of the Procuratorate, realized the good interaction between theory and knowledge, fully appreciated the power of law, cultivated my own rigorous and fair concept, improved my legal literacy and comprehensive legal ability, accumulated a lot of legal practical experience, and strengthened my own pace of legal progress.
During the internship, I was able to abide by the work discipline, never be late or leave early, be active and willing to work, learn initiative and patience, and conscientiously complete the work assigned by the prosecutor, which won unanimous praise from the leaders and prosecutors, but I also found many shortcomings. Here, I organize my internship records and write this internship report in combination with my experiences, practices and feelings during my internship in the Public Prosecution Department of Huicheng District People's Procuratorate.
First, about the internship unit
According to the Constitution and the Organic Law of the People's Procuratorate, the People's Procuratorate is the legal supervision organ of the state and exercises the procuratorial power of the state. The public prosecution department is the department with the most business in the procuratorate, and as one of the core departments of the procuratorate, its affairs are complicated. The Public Prosecution Section is mainly responsible for reviewing cases transferred by public security organs, state security organs and investigation departments of people's procuratorates for prosecution or non-prosecution, deciding whether to prosecute or not, appearing in court to support public prosecution, supervising the trial activities of people's courts, and protesting against criminal judgments and rulings that are indeed wrong. As an intern in the Public Prosecution Section of the Procuratorate, I personally experienced the real and standardized judicial procedure, followed the police officers for questioning, verified the facts of the crime, inquired about the criminal psychology and motivation, and really understood and became familiar with the procuratorial practice.
Second, about the purpose and content of internship.

1. Through practice, the theories studied in universities are mainly criminal law, criminal procedure law and legal practice, so as to consolidate knowledge, find out deficiencies, accumulate experience and promote learning;

3. Familiar with the relevant laws and regulations of procuratorial business and the work discipline of procuratorial personnel;
4. Contact and communicate with prosecutors and accept guidance with an open mind;

4. Assist the prosecutors of the Public Prosecution Office in their daily work;
5. Attend the court with the prosecutor;
6. Fill in the case registration form, replace the pledge card, apply for various proposals, and copy and print the back office work.
Third, about the internship process.
This internship was linked at the time of the final exam, and the time will be relatively short, and the internship happens to be cold, so the internship is quite hard. Come to the procuratorate and learn a little about the structure of the procuratorate: including investigation and supervision, public prosecution, dereliction of duty and infringement prosecution, civil administrative prosecution, anti-corruption and bribery bureau, Shenke control and other departments. Suddenly I saw so many unfamiliar departments, but when I came to practice with my work permit, I was still a little proud, although I was not a formal staff member of the procuratorate. I think my words and deeds represent the image of the procuratorate. From the beginning, I vowed never to take it lightly. A mistake not only embarrasses oneself, but also embarrasses the law.
In the public prosecution, everyone is very busy every day, and the cases prosecuted are all criminal cases, such as intentional injury, drug trafficking, intentional homicide, robbery and so on. But they didn't lose their fun, because everything was new to me, and with a little nervousness, I gradually became full of expectations for going to work. Busy life is always full, and it is also a kind of training to feel the tension of work in advance.
During my internship, I experienced many firsts: the first time I learned about the criminal file, the first time I participated in the arraignment, and the first time I sent a notice ... In the face of a brand-new job, I was more excited and excited, and I understood the importance of modesty and prudence; Facing the familiar work, I also learned to feel, experience and learn through constant thinking. Here, I am also making progress every day.
On the basis of completing the general daily work, I pay attention to the following internship contents:
(a) through marking, familiar with the procedural requirements and the importance of evidence in handling criminal cases, and adapt to the comparison between marking and marking;
You can find out the charges and criminal facts, including the time, place, motivation, purpose, means and other criminal circumstances, as well as evidence materials. For each prosecution, we can see the importance attached by investigators and prosecutors to each case and their rigorous handling attitude, and at the same time let people find a set of procedural processes, from detention, filing, investigation, arrest, transfer for review and prosecution to prosecution, trial and execution of imprisonment.
(2) Summoning
Interrogation is an activity that the procuratorial organ interrogates the criminal suspect according to law in order to further understand the facts of the case transferred to the procuratorial organ for examination and prosecution, examine the authenticity of the case file evidence transferred by the investigation organ and the legality of the investigation activities. Due to the trust of the prosecutor, I tried 13 criminal suspects, mainly involving theft, robbery, robbery, intentional injury, traffic accidents and other crimes. I quickly entered the role during the arraignment, and I was not careless at all. I went smoothly from filling in the time and place of arraignment, showing my identity, verifying the basic situation of the suspect, asking every question, including whether to plead guilty, the time and place of committing the crime, and signing for verification. The whole process of arraignment gave me a deeper understanding of seeking truth from facts and fearing the law. I'm not nervous at all. If it's not enough, it's that the experience and skills of interrogation and the ability to ask questions are still lacking.
According to my experience in arraignment, I think the following points should be paid attention to in order to make a good record:
1, the basic idea of interrogation. Generally speaking, they will first identify themselves and inform the suspects of their basic rights and obligations; Secondly, the basic situation of the criminal suspect and the time to take compulsory measures will be checked; Thirdly, some problems that affect conviction and sentencing will be raised to the criminal suspect on the criminal facts identified by the investigation organ, which are generally raised around factors such as time, place, person, motivation, tools, behavior and results; Finally, the suspect will be asked to make a final supplementary statement.
2. Record the question-and-answer process in written language, which is fast and not every word should be remembered.
3. When you encounter a person's name or place name during recording, you should refer to the prosecution opinion and not make subjective assumptions; If the transcript is altered, the criminal suspect must confirm and press the fingerprint.
Fourth, about the internship experience.
This internship, I really came into contact with the actual work of the procuratorate, improved my practical ability and cognitive level, and also made me understand some truth and have a profound experience.
(1) Deeply feel the lack of knowledge. From this point of view, classroom knowledge is irreplaceable for grasping the direction of work as a whole and guiding some work. Strengthening the study of classroom knowledge is very important for work. At the same time, we should also realize the embodiment of the importance of practical experience-experience can often improve efficiency; Theoretical knowledge must be tested and recognized by practice; School learning is divorced from the needs of practice. We only know what the system should look like in theory, but we don't know how it works in practice. We only know how this situation is stipulated in law, but we don't know how to deal with it in practice.
(2) We must expand our knowledge, enhance our comprehensive quality, find out the shortcomings, make up for them, and carry out practical work in a down-to-earth manner. This is very necessary for self-improvement, understanding the environment of the parties and investigating the case.
(3) In the future study, we should handle the relationship between classroom learning and social practice, as well as the relationship between theoretical knowledge and practical content according to the experience gained from this internship.
(4) What maturity needs most is a calm, rational and tolerant heart. The original self simply thinks that the world is pure and beautiful, so it is too easy to be influenced by appearances, but there is always a gap between ideal and reality. We should learn to give ugliness, suffering and misfortune a correct concept and attitude.
(5) Establish legal authority, and the fairness of the law has an impact on the parties. Criminal law and criminal procedure law also have educational functions. I think a country ruled by law needs to cultivate citizens' respect for law and human rights, and this respect is actually respect for themselves. Besides, it is futile to talk about faith in the law. Those criminal suspects must have a hard time in it, because they not only lost their freedom temporarily, but also lost the warmth of their relatives and home, and were forced to work in it, with extremely poor conditions of food, clothing, housing and transportation. Finally, they will be punished by law. However, this is the price they must pay. If you infringe or deprive others of their legitimate rights and interests, the law will be restored and justice will be done to others and society! I also fully realize the relationship between freedom and law-abiding and its importance. The function of law is to adjust various social relations. Specifically, criminal law is to punish crimes and protect people. The law recognizes and protects everyone's freedom and rights, but it also punishes violations of others' freedom and rights.
