Finance, human resources and social security departments shall, according to their respective responsibilities, do a good job in the management of auxiliary personnel. Article 5 Auxiliary personnel shall meet the following conditions:
(1) Citizens aged 18;
(2) Good conduct;
(3) Physical conditions and working ability required for performing duties;
(4) Proof of educational level and professional and technical qualifications required for the proposed position. Article 6 An assistant shall not be employed under any of the following circumstances:
(1) Having received criminal punishment or being suspected of violating the law and crime, which has not been ascertained;
(2) Those who are receiving education, reeducation through labor, compulsory detoxification or administrative detention;
(3) Being expelled from public office by a state organ or institution;
(four) other circumstances that are not suitable for supporting work. Article 7 Under the command and supervision of the public security organs and their people's police, police auxiliary personnel shall assist the people's police to perform the following duties:
(a) the actual population management in the community, the internal security management of enterprises and institutions within the jurisdiction of the police station, the management of public places and mass services;
(2) Public security patrol, bayonet duty, receiving police, maintaining the order of large-scale public activities and unexpected cases (incidents), surrender of criminal suspects, mediation of civil disputes that are not handled as cases, publicity and education on public security prevention, etc.
(3) Dredging traffic, discouraging or assisting traffic police to check and correct traffic safety violations, maintaining order at the scene of traffic accidents, protecting or assisting traffic police to explore the scene of accidents, rescuing the injured, and carrying out traffic safety publicity and education and window services;
(four) to assist the fire supervision and management and fire fighting and rescue;
(five) to carry out anti-drug publicity and education, daily management services for drug addicts, and drug investigation in public places;
(six) information collection, data statistics, written records, video inspections, etc. Public security organs;
(seven) other police auxiliary work arranged by the public security organs. Article 8 Under the command and supervision of the urban management department and its law enforcement personnel, the urban management auxiliary personnel shall assist the urban management law enforcement personnel to perform the following duties:
(a) to publicize the laws, regulations and rules of urban management;
(two) to participate in the daily management of the city and conduct dynamic inspections of the management area;
(three) to discourage and stop acts in violation of city management regulations, and to urge and correct illegal acts;
(four) to collect and timely reflect the opinions and suggestions of the units and individuals in the management area on the administrative law enforcement of urban management;
(five) information collection, data statistics, written records, video inspections, etc. Urban management department;
(six) other urban management auxiliary work arranged by the urban management department. Ninth auxiliary personnel shall not engage in the following work:
(a) involving secret work without the authorization of the department;
(two) administrative licensing, administrative fees, administrative penalties, administrative confirmation, administrative compulsory measures and other administrative law enforcement work;
(three) other work that should be performed by the people's police and urban management law enforcement personnel as stipulated by laws, regulations and rules.
Auxiliary police are also not allowed to engage in on-site investigation of criminal cases, investigation and evidence collection, execution of criminal compulsory measures, interrogation of criminal suspects, etc. Tenth auxiliary personnel shall not have the following acts:
(1) Failing to perform duties and delaying work;
(2) Refusing to execute orders;
(3) divulging state secrets and work secrets;
(four) corporal punishment, abuse of each other;
(5) using weapons and police equipment;
(6) Asking for or accepting bribes;
(7) Drinking alcohol during working hours;
(eight) to participate in business activities related to the performance of duties or to take advantage of the convenience of work to buy goods and receive services;
(nine) employed by other individuals or organizations;
(ten) other violations of law and discipline. Eleventh auxiliary personnel shall enjoy the following rights:
(a) to obtain the working conditions that should be met to perform their duties;
(2) Obtaining remuneration for labor according to law and enjoying legal welfare and social insurance benefits;
(three) to accept the business knowledge training required for the post;
(four) to lodge complaints and accusations according to law;
(five) to request the dissolution or termination of the labor contract according to law;
(six) other rights stipulated by laws, regulations and rules. Twelfth auxiliary personnel to perform their duties in accordance with these measures shall be protected by law, and relevant citizens, legal persons and other organizations shall cooperate.
