According to the introduction of Danfeng County Procuratorate, at about noon 12 on March 8, the procuratorate received a notice from the county public security bureau that Xu, a suspect in the "2. 10" murder case, was yellow, short of breath, weak pulse and drooling during the trial, and died after being sent to the hospital for rescue. He asked the procuratorate to intervene and conduct a forensic examination of Xu's body. The county procuratorate randomly intervened in the investigation. On the same day, the Anti-Dereliction and Infringement Bureau of the Municipal Procuratorate immediately launched an integrated investigation mechanism and intervened in the investigation after receiving the report from the county procuratorate. On March 9, entrusted by Shangluo City Procuratorate, Danfeng County Procuratorate, Shaanxi Provincial Procuratorate forensic doctor Bai Ningbo and Municipal Procuratorate forensic doctor Yang Zaixu's relatives inspected Xu's body in the presence of representatives.
Since then, the city and county procuratorial organs, in accordance with the relevant legal procedures and regulations, have read and checked the relevant files and materials of the public security organs about the "2. 10" murder case (hereinafter referred to as the "2. 10" case) and asked the relevant case handlers. This paper mainly investigates the law enforcement process and behavior of public security organs in handling the "2. 10" case, especially the interrogation of criminal suspect Xu. After a recent period of investigation, combined with the expert conclusion of forensic examination, it is preliminarily found that the "2. 10" project headquarters and task force of Danfeng County Public Security Bureau have serious illegal acts in the process of interrogating criminal suspects. Individual commanders and a few policemen extort confessions by torture, and some have been suspected of committing crimes.
After investigation, on the evening of February 28th, at 1 1, the "2. 10" task force of the county public security bureau summoned senior three students (10) who were suspected of serious homicide to the public security organs for questioning. The next day, Xu explained the process and motivation of killing the victim of "2. 10". On March 1 0, the "2. 10" project headquarters decided to put Xu into criminal detention and organized the police for further questioning. From March 8 1 to 6: 00 the next morning, investigators conducted a long and uninterrupted fatigue interrogation of the suspect Xu Jin in the criminal police team and police station of the county public security bureau. Several policemen also physically assaulted Xu during the interrogation, which caused Xu to be extremely tired, leading to cardiac arrest and died after being rescued.
The Danfeng County Procuratorate said: In view of the illegal acts and responsibilities of the "2. 10" project headquarters of Danfeng County Public Security Bureau and a few policemen, according to the relevant laws and regulations, the director of Danfeng County Public Security Bureau and the commander-in-chief of the "2. 10" project headquarters have been investigated on suspicion of abuse of power, and in view of their surrender, compulsory measures have been taken to obtain bail pending trial; Wang, secretary of the Disciplinary Committee in charge of criminal investigation of Danfeng County Public Security Bureau and deputy commander of the "2. 10" project headquarters, was placed on file for investigation and criminal detention on suspicion of dereliction of duty; Sun Peng, the captain of the Criminal Police Brigade of Danfeng County Public Security Bureau and a member of the "2. 10" project headquarters, was placed on file for investigation and criminal detention on suspicion of dereliction of duty; Zhao Shuo, instructor of the Criminal Police Brigade of Danfeng County Public Security Bureau and leader of the "2. 10" task force, was placed on file for investigation and criminal detention on suspicion of extorting a confession by torture; Jia Yangang, the captain of the Fourth Squadron of the Criminal Police Brigade of Danfeng County Public Security Bureau and the interrogator of the "2. 10" task force, was placed on file for investigation and criminal detention on suspicion of extorting a confession by torture; Li Hongwei, a policeman of the Criminal Police Detachment of Shangluo Public Security Bureau and an interrogator of the "2. 10" task force, was placed on file for investigation and criminal detention on suspicion of extorting a confession by torture; Wang Wei, a policeman of the Fourth Squadron of the Criminal Police Brigade of Danfeng County Public Security Bureau and an interrogator of the "2. 10" task force, was placed on file for investigation and criminal detention on suspicion of extorting a confession by torture.
