2. If a criminal suspect or defendant in custody or under residential surveillance is under any of the following circumstances, the defense lawyer shall apply for bail pending trial for him: (Note: the conditions for bail pending trial will be strictly controlled in the case of pest control)
(1) may be sentenced to public surveillance, criminal detention or independent application of supplementary punishment;
(2) may be sentenced to more than fixed-term imprisonment, and taking measures to obtain a guarantor pending trial will not cause social danger;
(3) The criminal suspect or defendant suffers from a serious illness and cannot take care of himself, and taking measures to obtain a guarantor pending trial will not cause social danger;
(4) The criminal suspect or defendant is pregnant or breast-feeding his own baby, and taking measures to obtain bail pending trial will not cause social danger;
(5) The detention period expires, and the case has not yet been settled, so it is necessary to take bail pending trial.
