The illegal activities of Zhang and others not only destroyed the aquatic biological resources in the relevant waters, but also destroyed the ecological environment of the waters, resulting in damage to public interests. According to the relevant laws and regulations, if Zhang and others cause damage to aquatic biological resources, they should bear civil liability in addition to criminal or administrative liability, and compensate for the ecological environment and resource restoration costs.
In order to improve the effectiveness of procuratorial public interest litigation, enhance the public's awareness of the rule of law and ecological civilization, and enhance the openness and transparency of judicial activities, the Second Branch of Tianjin People's Procuratorate decided to conduct a door-to-door procuratorial hearing on the civil public interest litigation case of illegal fishing of aquatic products by Zhang and others, and invited three volunteers with professional knowledge to serve as hearing officers through the procuratorial cloud platform. At the same time, representatives of relevant district administrative law enforcement units, township governments and village committees are invited to participate.
At the hearing, the hearing officer inquired about the illegal behavior of the parties, the damage value, the repair method, and the post-event supervision. The administrative organ expounded the harm of electric fish to the ecological environment and personal safety, and representatives of township governments and village committees put forward opinions and suggestions on how to implement the responsibility of ecological restoration. The prosecutor in charge analyzed the characteristics, harmful consequences and legal responsibilities of Zhang and others' illegal acts in combination with the case, and reminded villagers to know and abide by the law and safeguard the ecological environment around them through case interpretation.
