Chen died on the third day of the third lunar month. On February 6th, around 10, Zhu Min, the nephew of the deceased, as a representative of his family, was called downstairs after receiving the call and got on a bus of the Public Security Bureau.
Besides the driver, there were three people on the bus, including two policemen from xiushui county Public Security Bureau and Chengnan Police Station. Zhu Min was told orally that his uncle Chen Xiaochen died suddenly after falling from a building in xiushui county detention center. The police officer said that he got up at about 2 am to go to the toilet, fell down and fainted. At about 5 o'clock, he was found by the patrolling police and sent to xiushui county People's Hospital, where he died after being rescued.
The police officer also said that Chen was in poor health. He fainted in the detention center before, and the doctor checked that it was hypoglycemia. These days, the detention center has improved the lives of detainees, and may eat too well and have diarrhea.
Chen, 45, a native of xiushui county, is a laid-off worker from the former County Tea Research Institute. Two years ago, his wife left him without any divorce formalities. After his only daughter got married, he lived alone and was very poor. Chen works as a deliveryman in a hotel in the county. As the year is approaching, cash-strapped Chen hides more than 6,000 yuan worth of liquor in his shop at home. When the boss found out, he called the police and everyone was arrested. On June 4th, 65438, Chen was criminally detained by Chengnan Police Station on suspicion of stealing alcohol, and was held in cell 6 of xiushui county Detention Center.
According to the information disclosed after Chen's sudden death, he was arrested in June+10/October+March, 65438. However, family members reported that Chen's family never received any relevant notification documents from criminal detention to arrest. It was not until the evening of February 1 1 that Chen called his relatives from the detention center, and their relatives knew that he had been arrested. They thought he was missing.
Chen said on the phone that he didn't have enough to eat in the detention center and asked his relatives to remit some money to buy food. On the afternoon of February 13, Zhu Min and Chen's younger brother came to the detention center and sent 300 yuan cash and food through a deputy director named Liang, but they didn't see Chen himself.
Relatives said that Chen was in good health and physical strength before his death, and there was no problem in moving the finished wine to the seventh and eighth floors.
■ First Coordination Meeting: County Procuratorate intervened in the investigation.
Zhu Min, who learned of his uncle's death, immediately went to xiushui county funeral home. The deceased's eyes were open, and there were many striking scars and blood on his eyes, forehead, nose bridge and chest, and his neck was obviously bruised.
Zhu Min said, "My first instinct is that my uncle must have been beaten before he died! How can you even have a scar on your neck when wrestling? Moreover, how can a normal person's forehead and nose fall to the ground? Only an action similar to hitting the wall can leave such a scar! "
Relatives who came to see the body one after another also expressed doubts and wanted to transfer the body for preservation, but they were stopped by dozens of public security policemen who were guarding the funeral home. The situation once intensified. At 3pm, Kuang Jun, deputy secretary of the Political and Legal Committee of xiushui county, presided over the first coordination meeting between relevant departments and representatives of the families of the deceased. Kuang Jun said at the meeting that the xiushui county Procuratorate has been involved in the incident investigation, and Jiujiang City also attaches great importance to this matter, and will send a forensic doctor to come over, hoping that the family members can solve it in an orderly manner.
Some family members noticed that the deceased was wearing a red T-shirt, unlike his own clothes, so he proposed to send the clothes of the deceased to the detention center and cremate them with the deceased according to local customs. It was not until 9 o'clock in the evening that the clothes of the deceased were taken out of the detention center by their brothers Chen Xiaohua and Chen Haiqing. Coat, autumn clothes, trousers, etc. Not only is it as wet as being soaked in water, but there are also several obvious tears on the coat.
"Why are the clothes wet? The coat is torn, too? " The more puzzled the family members, the relevant parties explained that Chen had diarrhea twice that night when he added food to the New Year detention center. "The clothes were soaked with diarrhea."
"This is an insult to our IQ. Did you have diarrhea on your shirt? " Chen, the niece of the deceased, suspected that the clothes were washed to destroy the evidence. "When I first saw the body, there was blood on the face of the deceased."
■ Second briefing: Preliminary diagnosis of myocardial infarction
Late at night 12, Kuang Jun, deputy secretary of the Political and Legal Committee of the county party committee, once again called relevant departments and five family members to hold the second briefing.
A person in charge of the county procuratorate surnamed Zhang reported the preliminary investigation results at the meeting. He said that after the incident, the county procuratorate set up an investigation team consisting of 10 people. After a day's investigation, the preliminary conclusion is: Chen's death ruled out violence, and CT examination showed that the skull of the deceased was normal; In the early morning of February 16, Chen got up to urinate and accidentally fell. At about 5: 00 in the morning, the detainees in the same cell found Chen fainted to the ground and was taken to the county people's hospital, where he died after being rescued. After hospital diagnosis, the cause of Chen's death was initially diagnosed as myocardial infarction, and the time of death was 6: 05 in the morning.
The family immediately questioned how to explain the injuries on the face and neck of the deceased. Zhang explained that it was caused by a fall.
The next day, the relatives of the deceased submitted a written report on the application for autopsy to the forensic doctor of Jiangxi Provincial Public Security Department.
■ Autopsy expert's opinion: The final conclusion is "death"
At 3: 00 pm on February 19, in the presence of four relatives of the deceased, three staff members of Jiangxi Provincial Procuratorate and Provincial Public Security Department and forensic doctors dissected the body.
On the morning of March 10, the county government called nine relatives of the deceased and released the autopsy report dated March 4.
The 9-page report shows that more than 70 epidermal shedding or subcutaneous bleeding were found on the head, face, trunk and limbs of the deceased. "According to the damage morphology analysis, the body surface damage of the deceased was formed by contact with rough surface objects." In addition to bruises and contusions on the body surface, old contusions were found at the bottom of the brain of the deceased. "It is formed by indirect violence, which is consistent with the direct impact of brain tissue on the bone ridge at the uplift."
Autopsy pathological examination also found that the deceased suffered from adrenal medullary hyperplasia, chronic pleurisy, chronic bronchitis, chronic interstitial nephritis, enteritis and other diseases. According to the analysis of the report, "adrenal medullary hyperplasia can lead to excessive secretion of autonomic catecholamine and produce corresponding symptoms. According to the investigation, the deceased suddenly fainted on February 10, with symptoms and signs such as dizziness, palpitation, sweating, pale face and rapid heartbeat, and suddenly fell to the ground on February 10. These symptoms and signs are consistent with the symptoms of adrenal medullary hyperplasia. "
The report's "appraisal opinion" is that Chen died of heart and lung failure due to adrenal medullary hyperplasia and abnormal catecholamine secretion on the basis of lung and renal insufficiency. Rule out the possibility that the deceased died of mechanical injury, mechanical suffocation or poison poisoning.
Chen Si, the daughter of the deceased, immediately asked: How did the injuries on the deceased come from? Kuang Jun, deputy secretary of the Political and Legal Committee of the county party committee, explained that before Chen was arrested, the hotel owner had beaten Chen with beer bottles and umbrellas. 10 3 65438+ On the day of being arrested, Chen Zeng jumped from the stairs next to his window; On October 26th, 65438/kloc-0, Chen fainted once in the detention center.
Kuang also revealed that on the day of the February 16 accident, Chen went to the toilet several times because of diarrhea, and the whole room stinks and was beaten by the detainees in the same prison. However, according to the investigation, Chen's beating was not fatal. Chen Mou's beating behavior will be dealt with according to relevant laws and regulations.
■ Handling: The county magistrate was dismissed.
The person in charge of the county public security bureau also announced the handling of the relevant personnel in this case: Fan Lianwu, director of the xiushui county Detention Center, was dismissed; In charge of the police suspended for investigation; The police on duty that day were investigated; The leaders in charge of the public security bureau make a written inspection to the party Committee of the bureau.
On March 10, the family of the deceased consulted the forensic appraisal agency for the autopsy report through their lawyers. The feedback from the other party is that the "appraisal opinion" in the autopsy report is not the "appraisal conclusion", and the appraisal report is based on the "investigation reflection" of relevant departments, which is not rigorous and objective enough, and does not identify the time of death, but only investigates the time of death.
On the afternoon of March 12, the deceased's younger brother Chen Xiaohua and the deceased's daughter Chen Si submitted a written application to the xiushui county Procuratorate, requesting the investigation team to announce the investigation conclusion of the case to their families, but they were rejected. A deputy procurator-general of the county procuratorate said that after autopsy, the prisoner died of illness and did not need family members to obtain relevant information; Moreover, without the consent of the county party Committee, according to the discipline of handling cases by procuratorial organs, it shall not be announced to the public.
■ Survey: Doctors write diagnoses at will.
Chen's report "Death due to a preliminary diagnosis of myocardial infarction" was written by the director of the Second Department of xiushui county People's Hospital. On March 2, several relatives of the deceased went to the hospital office and medical department to ask for a diagnosis report, and were told that they had been taken away by the relevant departments.
On March 3, I told reporters on the phone that at about 5: 35 on February 16, Chen was taken to the hospital, "his breathing and heartbeat were gone", but according to hospital regulations, he had to be rescued for half an hour, so the time of death was written at 6: 05.
Zhu said that at that time, someone at the detention center introduced him to the situation of the deceased, and two people came from the county public security bureau and the procuratorate. "At that time, there was nothing we could do. They asked you to write a diagnosis ... They said that everyone in the detention center was panting, and we couldn't figure it out, so we had to tell him. "
"I will write a suspicious diagnosis of myocardial infarction, and I can't write anything else. To tell you the truth, we can't draw a conclusion without any examination for such a person who has no breathing and heartbeat. I am not biased on either side of this matter. I can only write one at will according to the situation they reflect, and then add a question mark to express my doubts. "
Zhu said, "I can't write about it being killed or what it is. At that time, let me draw a conclusion, and I can only draw such a conclusion.
