1980 February Notice of the Ministry of Civil Affairs and the Ministry of Finance on Implementing the Interim Provisions on Survivors' Living Allowance after the Death of Staff of State Organs and Institutions (Minfa [1980] No.5, Chua [1980] No.34) and other regulations:

(1) After the death of a staff member of a state organ or institution, if the survivors have difficulties in living, the unit where the deceased worked before his death may grant regular or temporary subsidies in accordance with the principle of "more subsidies in case of great difficulties, less subsidies in case of minor difficulties, and no subsidies without difficulties".

(2) The subsidy standard for survivors' living difficulties is generally based on the principle of maintaining the living standards of local people, and the specific standards are stipulated by provinces, municipalities and autonomous regions (the central state organs and institutions implement the standards in their respective regions). For those who died in the protection and rescue of state-owned assets or in the struggle against the enemy, the subsidy standard for the living difficulties of their survivors may be appropriately raised. Survivor's allowance is calculated according to the number and standard of survivor's allowance, and its total amount shall not exceed the salary of the deceased before his death.

(3) The object of subsidy refers to the following immediate family members and other relatives that the deceased relied on to support before his death: ① The father (including the dependents who raised the deceased) and the husband are over 60 years old, or have basically lost their ability to work; The mother (including the dependents who raised the deceased) and his wife have reached the age of 50, or have basically lost their ability to work; (3) Children (including children born to a posthumous child, adopted son, ex-wife or ex-husband) are under the age of 16, or are still studying in ordinary middle schools at the age of 16, or are basically incapacitated; (4) Brothers and sisters (including half-brothers or half-brothers) are under 16 years old, or 16 years old are still studying in ordinary middle schools, or have basically lost their ability to work.

(four) the remuneration obtained by the above-mentioned subsidy object to participate in labor or agricultural production shall be regarded as my living expenses, and shall be included in this part of income when calculating the subsidy standard for living difficulties.

(5) If the spouse of the deceased has a fixed income, after deducting the necessary living expenses, the rest will be used as the living expenses of the survivors, and subsidies will be given if it is insufficient. The deduction standard is determined by each region according to the living standards of ordinary employees in the region.

(6) After the survivors enjoy regular subsidies, if there are special difficulties, the unit where the deceased lived may also give temporary subsidies as appropriate.

(seven) the survivors who enjoy the subsidy may reduce or stop the subsidy for living difficulties according to the new situation because of the increase in economic income, employment and layoffs.

(8) The subsidy for the living difficulties of the survivors shall be paid from the funds of the unit where the deceased lived.
