During my internship, I also found it very important to popularize the law. Our government has made great achievements in legal education activities for many years, which has promoted the construction of the rule of law. People's legal concept and legal consciousness have been greatly improved. However, there are still some shortcomings in the depth and breadth of law popularization. For example, sometimes, people know some legal provisions, but they don't know how to apply them, so that they violate the law; Sometimes people don't understand the provisions of two or more different laws on the same issue and don't know which law to apply. There is a case like this. The defendant used to be an accountant in a village, but later he was reelected and lost, so he needed to hand in some accounting books and vouchers. However, he always thought that the Accounting Law stipulated that accounts should be paid after liquidation, so he insisted on not paying them, and was also arrested for hiding accounting books and accounting vouchers. This case shows that our legal popularization activities should not only stay on the surface, but also go deep into reality and really let people know the significance of laws and regulations. And on this basis, gradually establish people's belief in the law and establish the sacred status of the law. Only in this way can there be hope for the rule of law.

Another problem is juvenile delinquency. In the cases contacted in the internship, a large part of the defendants were born after 1980s, and even two defendants who committed robbery were born in 1987. Regardless of the defendant's family and his own factors, from the social environment, I think society also has certain responsibilities. From the beginning of the reform in the early 1980s to the end of the 1980s, it was a period of great change. During this period, the construction of spiritual civilization has been relaxed, that is to say, some criminals may have contracted some bad habits in their childhood. Therefore, education should start with dolls, not just a slogan, but really be implemented.

I know the difference between practice and theory by following the case. The theory is systematic, but the cases in practice are very messy because of the different time and place, and it is impossible to get them without rich experience and ability.

Third, the application of professional knowledge in practice.

I majored in law at school, which can be said to be a comprehensive study. However, because the crimes of dereliction of duty and infringement under the jurisdiction of the Department of Dereliction of Duty of the People's Procuratorate include the crimes of infringement of citizens' personal rights and democratic rights committed by state personnel by taking advantage of their powers as stipulated in Chapter IV of the Specific Provisions of Criminal Law and the crimes of dereliction of duty as stipulated in Chapter IX of the Specific Provisions of Criminal Law, the main ones that are of practical value to my internship in the Department of Anti-Dereliction of Duty and Infringement are the Criminal Law and the Criminal Procedure Law.

First of all, the constitution and determination of these charges in criminal law are of great guiding significance to the determination of crimes; In the criminal procedure law, the jurisdiction of the people's procuratorate to independently investigate cases is the basis of the work of the anti-dereliction and infringement department. Secondly, because the social relations adjusted by the criminal law itself are extremely complicated and the state functions are extensive, it is necessary to use the knowledge of accounting, taxation, transportation and other disciplines when investigating and dealing with the crime of dereliction of duty and infringement. In dealing with some related cases, I obviously feel the importance of other professional knowledge to the work of anti-dereliction of duty and infringement. If you don't know enough about this knowledge, then you can't see the problem, and maybe you will become a layman.

Finally, in the process of handling legal documents, I feel that the types of legal documents in practice are much more than those in books. Although the document format is different, it is similar to what was said in class.

Four, the problems found in the internship process and their causes and solutions

Due to the complex characteristics of dereliction of duty infringement cases and some imperfections in China's system, many problems have appeared in dealing with dereliction of duty infringement cases. Combined with my observation, I found the following problems:

First of all, the case follow-up work has not been done enough. After the investigation, the investigators failed to deal with the causes of the case and put forward judicial suggestions to some units in time, which was not conducive to re-preventing crimes.

Secondly, in the process of handling cases, the application of modern scientific and technological means is not perfect. During my internship, when I was in Liaoning Province, I recorded and videotaped the whole interrogation process. However, in the process of tracking the case, I found that these technical equipment is not perfect, the corresponding software programs are not very advanced, and the technical means of technicians are not skilled.

Finally, the efficiency of handling cases across regions is not high enough. On this internship business trip, I found that the trip was so far away, just to verify a few questions, and I had to go back a few days later. The efficiency of law enforcement was not very high, which wasted the national judicial resources.

Of course, the problems in practice are not limited to these. These are just what I see and feel. Analysis of the reasons, nothing more than the following:

First, the case handlers have an attitude of "nothing to do with themselves, hanging high", only paying attention to the problems in their own cases, not paying attention to the causes of crimes, and being afraid of offending other organs and personnel.

Second, the training and learning system is not complete, and the learning and training of technicians has not kept up with the times. Moreover, due to the single skill of technicians, they cannot adapt to the professional characteristics of case recording and video recording.

Third, regional cooperation is not strong. The function of judicial assistance in different places has not been fully exerted.

In view of the causes of these problems, we should start from the following three aspects to gradually solve and eliminate these problems:

To improve the responsibility of case handlers, we should not only focus on their investigation activities, but also focus on the problems they encounter in handling cases. Where crimes are prone to occur in a case, let the case handlers give judicial advice; Strengthen the re-prevention work after the case is handled to prevent similar situations from happening.

Strengthen the study and training of technical personnel, ask them to keep pace with the times in policy and discipline, and ask them to master interdisciplinary knowledge as much as possible.

Fully strengthen regional judicial cooperation, make full use of local judicial resources for cases that do not need to be handled in different places, and at the same time cooperate with each other's judicial assistance requirements.

V. Internship experience

This internship, I really came into contact with some legal work, improved my practical ability and cognitive level, and also made me understand some truths and have a profound experience.

(4) We must broaden our knowledge and improve our comprehensive quality. The cases contacted in this internship are all related to other sciences. In the process of auditing accounts, knowledge of accounting and taxation is extremely important.
