Article 29 Whoever, in violation of regulations, crosses or destroys the protective net of the first-class protected area without authorization shall be ordered by the competent administrative department of environmental protection to stop the illegal act, and the responsible person shall be fined more than 20 yuan 1000 yuan.
Thirtieth in violation of the provisions of Article 14 of these regulations, one of the following acts, by the competent administrative department of environmental protection shall be ordered to stop the illegal behavior, make corrections within a time limit or take other remedial measures, and impose a fine of 5000 yuan to 50000 yuan on the responsible unit, and impose a fine of 1000 yuan on the responsible person:
(1) Directly or indirectly discharging sewage and waste liquid into water bodies and dumping garbage, muck or other solid wastes;
(2) stacking and storing garbage, muck and other solid wastes on beaches and bank slopes;
(3) Swimming on the surface of two reservoirs and one canal, conducting water training and other water sports and recreational activities;
(four) the establishment of livestock farms, livestock directly in the water;
(five) cleaning vehicles, clothes and other appliances directly in the water;
(six) the application of harmful fish medicine and highly toxic and highly residual pesticides;
(seven) camping, picnic and other tourism activities that pollute the water quality;
(eight) the use of mules, horses and other livestock for passenger travel;
(nine) other acts of water pollution.
The municipal water conservancy management department has the right to order the violators in Items (3), (5) and (7) of the preceding paragraph to stop the illegal act, and impose a fine of 1000 yuan on the responsible person.
Without the approval of the Municipal Environmental Protection Bureau, if the ship that has been launched or will be approved to be launched changes its use, the competent administrative department of environmental protection shall confiscate the ship or impose a fine of 5000 yuan to 50 thousand yuan.
Article 31 Whoever violates the provisions of Article 17 of these regulations and commits any of the following acts shall be ordered by the competent administrative department of environmental protection to correct the illegal act and take remedial measures, and the responsible unit shall be fined between 65,438 yuan and 65,438 yuan, and the person in charge of the unit shall be fined between 65,438 yuan and 65,438 yuan:
(1) Failing to establish or implement the responsibility system for water source protection of the unit, and failing to formulate emergency measures to prevent water pollution;
(2) stopping using pollution prevention equipment and facilities without approval or directly discharging untreated sewage into water bodies;
(3) Failing to take effective measures or report to the local people's government and the competent administrative department of environmental protection in time when an accident or other unexpected event has caused or may cause water pollution.
Article 32 If, in violation of the provisions of the second paragraph of Article 18 of these regulations, the pollutants discharged exceed the discharge standards and the treatment within the time limit is not completed within the time limit, the Municipal Environmental Protection Bureau shall report to the Municipal People's Government for decision, order it to suspend business or relocate, impose a fine of 1000 yuan on the responsible unit, and impose a fine of 1000 yuan on the person in charge of the unit.
Article 33 Anyone who, in violation of the provisions of Article 20 of these regulations, fails to engage in cage fish culture activities in accordance with the approved scale and place, and fails to report the fish culture situation in accordance with the prescribed requirements and time limit, shall be ordered by the competent administrative department of environmental protection to stop the illegal act, make corrections within a time limit, impose a fine of more than 5,000 yuan and less than 50,000 yuan on the responsible unit, and impose a fine of 1 yuan on the responsible person.
Article 34 Whoever, in violation of the regulations of the state and this Municipality on the administration of environmental protection of construction projects and the relevant provisions of these regulations, carries out construction in Miyun Reservoir and Huairou Reservoir Reserve shall be ordered by the competent administrative department of environmental protection to immediately stop construction or use, and shall be punished in accordance with the relevant provisions of the state and this Municipality.
For illegal examination and approval, the administrative responsibility of the responsible personnel shall be investigated by the relevant competent departments.
Thirty-fifth city planning, construction, water conservancy, public utilities, forestry, public security, health and other administrative departments in violation of these regulations, according to their respective responsibilities, shall be punished according to law.
Thirty-sixth district and county environmental protection bureau may impose a fine of 50 thousand yuan; A fine exceeding 50,000 yuan shall be reported to the Municipal Environmental Protection Bureau for approval.
Thirty-seventh if a party refuses to accept the decision on administrative punishment, it may apply for reconsideration or bring a lawsuit to the people's court according to law. If a party fails to apply for reconsideration, bring a lawsuit or perform the punishment decision within the time limit, the organ that made the punishment decision shall apply to the people's court for compulsory execution. Thirty-eighth in violation of regulations, causing serious pollution accidents, resulting in heavy losses of public or private property or serious consequences of personal injury, the relevant responsible persons shall be investigated for criminal responsibility according to law.
Article 39 Whoever refuses or obstructs the management personnel of two reservoirs and one canal from performing their duties according to law or insults or beats the management personnel shall be punished by the public security organ in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.
Fortieth two reservoirs and one canal management personnel should be loyal to their duties, enforce the law impartially and strictly manage. Dereliction of duty, abuse of power, corruption, by their units or the competent authorities at a higher level shall be given administrative sanctions, constitute a crime, shall be investigated for criminal responsibility according to law.
