Article 1 In order to standardize the system of paid annual leave for employees of bureau organs, arrange paid annual leave for employees in a planned and reasonable way, ensure the physical and mental health of employees, and mobilize the enthusiasm of employees, these Interim Provisions are formulated in accordance with the Labor Law of People's Republic of China (PRC) and relevant regulations, combined with the actual situation of bureau organs.
Article 2 The scope of employees who take paid annual leave is employees who have worked in the government for more than one year.
Article 3 New employees can enjoy paid annual leave after working for one year. If you complete one year in the first half of the year, you will begin to enjoy the paid annual leave of that year; Those who complete one year in the second half of the year will enjoy paid annual leave from this year. The calculation period of paid annual leave is 1/kloc-0 in October to//kloc-0 in February.
Article 4 All units can arrange paid annual leave for employees on the premise of ensuring the completion of production and business tasks, not increasing staffing and quota, and controlling overtime to the maximum extent. For seasonal construction units, in principle, employees are arranged to take paid annual leave in the off-season of construction.
Article 5 Annual leave with pay shall be implemented according to the following standards: those who have worked for more than one year but less than five years shall take five days off every year; If it is over five years and less than ten years, it will take 7 days off every year; For those who have completed ten years but less than fifteen years, they shall take annual leave 10 days; /kloc-annual leave for those over 0/5 years 14 days. Senior technicians who employ managers at or above the deputy division level, professional and technical personnel at or above the senior level, employees who have been rated as outstanding by the administration, academic and technical leaders, bureau-level technical experts, and provincial and ministerial-level model workers can take a vacation 14 days a year.
Article 6 In principle, annual leave with pay shall be arranged once a year, and shall be taken at one time. Holidays that have not been repaired in that year shall not be used across the year. For those who are inseparable from production jobs, each unit can arrange centralized leave or partial leave without applying for leave. Without proper reasons, employees' vacation time shall not be cancelled or squeezed at will. If you have not arranged a vacation for two consecutive years due to work needs, you must arrange a vacation in the third year.
Article 7 Employees' paid leave does not affect their enjoyment of family leave, maternity leave, marriage leave, funeral leave and medical leave for personnel in toxic and harmful posts. Upon approval, the above holidays can be combined with annual leave. Paid annual leave does not include public holidays and legal holidays. For those who implement paid personal leave, the number of days of paid personal leave should be reduced accordingly; Those who have finished taking paid annual leave will be deducted from the paid annual leave days of the following year.
Article 8 If an employee needs a vacation, he shall submit a written application one month in advance and examine and approve it according to the management authority. Those who have not applied or have not been approved may not take a vacation without authorization. Employees are not allowed to leave their posts on their own in the name of paid leave, otherwise they will be treated as absenteeism.
Article 9 Examination and approval procedures for annual leave with pay: Party and government posts and office posts in secondary units must be approved by the main leaders of the Bureau, and deputy party and government posts and office posts in secondary units must be approved by the competent leaders of the Bureau and reported to the Human Resources Department of the Bureau for the record; Other personnel of secondary units and bureaus (including directly affiliated units) shall examine and approve by themselves according to their management authority, and report to the personnel and labor department of the unit for the record.
Article 10 During the annual leave, employees will receive skill salary, post salary, seniority salary, wage travel allowance (excluding post allowance) and bonus as usual, and all insurance benefits will remain unchanged.
Eleventh some employees can't take a vacation because of their work needs in that year, and they can be given appropriate economic compensation. The daily standard of economic compensation is 200% of the daily standard of skill wage. Compensation funds shall be charged in the total wages of the unit, approved by the personnel and labor department of the secondary unit, and distributed in the first quarter of the following year.
Article 12 Employees who are approved to take vacations shall take vacations according to the approved vacation days. The number of days left unused due to personal reasons will not be compensated or compensated; If the approved leave days are overdue with the approval of the organization, they will be treated as unpaid leave, and if they are overdue without the approval of the organization, they will be treated as absenteeism.
Thirteenth employees leave, generally mainly on-site leave, leave out on their own, the cost of their own.
Fourteenth employees should pay attention to travel safety during vacation to avoid all kinds of safety accidents. In case of accidents such as safety, you are responsible.
Fifteenth employees in any of the following circumstances, shall not implement paid annual leave; If the paid annual leave is finished in that year, the paid annual leave in the following year will stop:
(1) Having worked in an organ for less than 9 months in that year;
(2) The number of days off by rotation (excluding legal rest days) of foreign construction workers who implement the system of rotation exceeds the number of paid annual leave days;
(3) When the organization has arranged rest and recuperation;
(four) full-time study for more than 6 months;
(five) personal leave accumulated more than 30 days or sick leave accumulated more than 60 days or absenteeism;
(6) Being expelled from the factory during the inspection;
(7) Being administratively detained by the public security organ in that year;
(eight) when the judicial organs take criminal compulsory measures such as obtaining a guarantor pending trial, residential surveillance, detention and arrest;
(9) Persons who are directly or primarily responsible for major accidents or major economic losses in that year;
(10) Failing to return to China within the prescribed time limit;
(eleven) other personnel who should not enjoy paid annual leave.
Sixteenth teachers or other employees of education and teaching units, who have enjoyed the winter and summer vacations, will no longer enjoy the paid annual leave as stipulated in this regulation.
Article 17 The Human Resources Department of the Bureau shall be responsible for the interpretation of these Provisions.
Eighteenth the provisions shall come into force as of the date of issuance.
