Measures for the administration of people's escorts (for Trial Implementation)
In order to enhance the openness of implementation, strengthen the supervision of implementation, explore the establishment of the people's escort system, and promote the healthy development of the people's escort work, these measures are formulated according to the work arrangements of the Higher People's Courts of the Supreme People's Court and Jiangxi Province on exploring the people's escort system, combined with the actual work in our city.
Article 1 A people's escort is a person selected by the people's court from qualified personnel in accordance with these Measures, who is engaged in participating in case trial, case execution, witnessing and supervising on-site execution, coordinating and handling major petition cases, assisting relevant lien delivery and other relevant execution auxiliary work.
Article 2 People's jurors may be selected from among people's jurors or appointed from other people who meet the requirements of people's jurors.
People's escorts are divided into ordinary, fixed and professional types, and the number in principle does not exceed the number of on-the-job and on-the-job police officers in the Executive Board of our hospital. Among them, the fixed personnel also need to have certain computer operation skills. Professionals need to have a certain legal knowledge background and rich experience in a certain industry.
Members of the Standing Committee of the People's Congress, staff of the people's courts, staff of public security organs, staff of state security organs, staff of judicial administrative organs and practicing lawyers shall not serve as people's escorts. A person who has received criminal punishment for a crime or has been dismissed from public office may not serve as a people's escort.
Article 3 Types of cases in which people's escorts participate:
(a) the case is complicated and needs to be reviewed by a collegial panel before a ruling can be made;
(2) Group disputes, livelihood cases, etc. ;
(three) by local and departmental protectionism and other interference;
(4) Seriously resisting execution or evading execution;
(5) Having strong professionalism;
(six) after the initial investigation, there may be no property available for execution;
(seven) the petition of the parties;
(8) Other personnel may be accompanied by members.
If it is necessary to form a collegial panel to review and make a ruling according to law, such as item (1) above, people's jurors with the qualification of people's jurors shall participate.
The People's Guard participates in the implementation of the regulations on evacuation.
