Chapter I General Provisions

Article 1 In order to strengthen the safety management of fireworks and firecrackers, prevent explosion accidents, reduce environmental pollution, and ensure the safety of the country and people's lives and property, these measures are formulated in accordance with the relevant provisions of the Regulations of People's Republic of China (PRC) on the Administration of Civil Explosives and in combination with the situation in our province.

Article 2 Unless otherwise provided by the state, these Measures shall apply to all units and individuals that produce, store, transport, sell and set off fireworks and firecrackers (including fireworks and firecrackers) in this province.

Article 3 Without approval, no unit or individual may produce fireworks.

Fourth fireworks safety management, by the production, storage, transportation and sales of fireworks enterprises and their competent departments.

Enterprises that produce, store, transport and sell fireworks and firecrackers must formulate safety technical operating rules and safety management systems for fireworks and firecrackers, establish and improve the post responsibility system, and educate employees to strictly abide by them.

Fifth public security organs shall supervise and inspect the safety management of fireworks and firecrackers in accordance with the provisions of these measures.

Chapter II Production Management

Article 6 The competent department of fireworks and firecrackers production enterprises shall strictly manage the production of fireworks and firecrackers, make unified planning and rational layout, and organize production in a planned and controlled manner. The labor department shall supervise the labor safety of fireworks production enterprises.

Seventh fireworks production enterprises should be built far away from cities and towns, and it is forbidden to produce fireworks in residential areas, scenic spots and nature reserves.

The safe distance between workshops and warehouses and the surrounding water conservancy facilities, traffic arteries, tunnels, bridges, high-voltage transmission lines, communication lines, oil (gas) pipelines and other important facilities and residential areas must conform to the provisions of relevant national safety codes, and corresponding safety facilities such as ventilation, cooling, moistureproof, fire prevention, explosion prevention, lightning protection and antistatic should be set up.

The distance between the production area and the living area must be more than 50 meters and separated by a wall; The distance between the workshop with drugs and the workshop with drugs and the general workshop should be more than 30 meters.

Distance between drug storehouse and production area and living area: the distance for storing explosive drugs containing less than one ton of potassium chlorate must be more than 500 meters, and the distance for storing explosive drugs containing more than one ton of potassium chlorate must be more than one kilometer; The warehouse of pyrotechnics, black powder and their raw materials without potassium chlorate shall be halved according to the above provisions; The distance between the finished product warehouse and the production area and living area is halved according to the number of drugs in the warehouse.

If an explosion-proof earth embankment is built, the above distance can be halved.

Article 8 The legal representative of a fireworks production enterprise shall be responsible for production safety. Enterprises must set up full-time safety management institutions, equipped with full-time safety management personnel. Safety management personnel shall supervise and inspect the safety production situation of enterprises, have the right to resist the production deployment of enterprise leaders who violate the safety system, have the right to stop illegal operations, and have the right to report the safety production situation to the public security organs and superior leadership departments, and expose relevant illegal personnel and facts.

Ninth fireworks production enterprises must be reported to the provincial authorities for approval in accordance with the affiliation. If it is seasonal production of fireworks, it should be reported to the local city and local competent department for approval. With the approval documents and design drawings, apply to the local county and city public security bureau. Upon examination, it is allowed to start construction if it meets the relevant provisions of these measures. After completion, if it meets the relevant national safety regulations after inspection and acceptance, the local county and city public security bureau will issue the Safety Production License for Explosives, register with the local administration for industry and commerce with the production license, and obtain the business license before production.

The expansion and reconstruction of enterprises that produce fireworks and firecrackers must be submitted for approval according to the original examination and approval procedures, and construction can only start after approval. After the project is completed and accepted, it can be put into production.

Enterprises that produce fireworks and firecrackers shall not contract the pharmaceutical process to households or outside the factory for processing.

Tenth fireworks drugs and their compatibility shall meet the following requirements:

(1) Potassium chlorate shall not be used as an oxidant for fireworks.

(two) a single charge of more than 0.05 grams of firecrackers shall not use potassium chlorate as explosive agent. The use of potassium chlorate as an explosive and other firecrackers with a single charge of less than 0.05g must be audited by the provincial competent department and reported to the provincial public security department for approval. The proportion of formula is generally controlled at 20%, and the highest proportion shall not exceed 28.6%.

(3) The mixture of realgar and potassium chlorate or antimony sulfide and potassium chlorate is prohibited for firecrackers, and red phosphorus is not allowed.

(four) it is forbidden to use any formula that can detonate when heated below 200℃ for five seconds to produce fireworks and firecrackers.

(five) it is forbidden to use toxic raw materials or raw materials that produce toxic gases by combustion.

When potassium chlorate is needed to prepare special fireworks and firecrackers for literature, sports and foreign trade export. , must be approved by the provincial department in charge of examination, and approved by the provincial public security department, designated specialized enterprises for quantitative production.

Without approval, it is forbidden to produce products that can spontaneously ignite and explode due to impact, extrusion and friction, such as pulling guns, throwing guns, smashing guns, and starting paper, as well as dangerous goods with irregular flight paths.

Article 11 When factories that use potassium chlorate to produce firecrackers need to buy potassium chlorate, they must strictly implement the provisions on the safety management of dangerous chemicals and go through the purchase and transportation procedures.

Illegal trading of potassium chlorate is strictly prohibited.

Article 12 In the workshop with drugs, the operators shall determine the working procedures and personnel, strictly control the storage quantity of drugs, and prohibit mixed working procedures and overproduction and overstocking.

Thirteenth production and management personnel, must be familiar with product performance, familiar with and strictly abide by the relevant provisions of the operating rules and safety in production. New recruits must receive technical training and safety education, and those who pass the examination are allowed to take up their posts.

To employ technical personnel, the applicant must hold the examination certificate of the competent department at or above the county level where his permanent residence is located, and shall not be employed without examination.

Fourteenth blind, deaf, dumb, physically disabled and other people who are not suitable for the production of fireworks and firecrackers are not allowed to engage in the production of fireworks and firecrackers drugs and the storage and transportation of fireworks and firecrackers drugs, finished products and semi-finished products.

Fifteenth in the process of contact with drugs, it is forbidden to use tools and appliances made of iron, enamel, ceramics, plastics and chemical fiber materials; It is forbidden to crush mixed drugs with stone mill, stone mill and other equipment; Grinding tanks, mortar, etc. are strictly prohibited. Mix the drugs in a dry state. All personnel entering the production area are not allowed to wear chemical fiber clothes, spikes and hard-soled shoes, and are not allowed to carry fire-fighting equipment and fire.

Sixteenth fireworks production enterprises must establish a strict drug management system. Drugs with conflicting nature must be stored separately. It is forbidden to mix finished products, semi-finished products, lead wires and drugs.

Seventeenth fireworks production enterprises must establish a strict quality inspection system, product quality must meet the relevant national standards. Unqualified products are not allowed to leave the factory. The product or small package must have the name, address, production date, product inspection certificate, and indicate the discharge method and precautions.

Chapter III Warehouse Management

Eighteenth enterprises must set up a special warehouse to store fireworks and firecrackers, and set up special personnel to manage them. The establishment of a special warehouse for fireworks and firecrackers must be approved by the local county and city public security bureau, and a "permit for storage of explosives" can be used.

The warehouse where fireworks and firecrackers are stored shall be equipped with corresponding safety facilities.

Nineteenth storage of fireworks warehouse, storage, distribution and warehousing registration system must be established. The number of fireworks and firecrackers stored in the warehouse shall not exceed the design capacity. It is forbidden to store other articles in the warehouse.

Chapter IV Transportation Management

Twentieth purchase units with product quality inspection certificate and order contract to the county, city public security bureau to apply for explosives transport license, can transport fireworks. After the goods arrive at the destination, the procurement unit shall endorse the arrival of the explosives on the transport certificate and return the certificate to the original issuing authority.

Short-distance transportation of fireworks and firecrackers in counties and cities can be exempted from explosives transportation license, but the county and city public security bureau must be notified in advance and transported according to the route and time specified by the public security organ.

Twenty-first transport fireworks, must abide by the relevant national railway, highway and shipping safety transportation rules. Vehicles transporting fireworks and firecrackers should be clearly marked and not allowed to stay in crowded places.

Twenty-second it is forbidden to carry fireworks in cars, boats and planes. Fireworks and firecrackers are strictly prohibited in checked, stored and mailed luggage, parcels and mails.

Chapter V Sales Management

Twenty-third fireworks purchase and wholesale business, by the supply and marketing cooperatives at all levels or the county and municipal people's government approved the department responsible for unified management. No business unit may purchase products produced by unapproved enterprises.

Sales outlets and supply points of fireworks and firecrackers are designated by the supply and marketing departments, commercial departments and public security organs through consultation, and the county and municipal public security organs issue explosive sales licenses and temporary sales licenses of fireworks and firecrackers at seasonal sales points, register with the local administrative department for industry and commerce, and obtain business licenses before they are allowed to sell.

When selling fireworks and firecrackers in rural markets, it is necessary to set up a special fireworks and firecrackers market and stay away from other stalls in the market. It is strictly forbidden to sell fireworks and firecrackers and set up stalls in cities and rural areas.

Twenty-fourth units selling fireworks and firecrackers must make special inventory, counter sales and special sales, and sales personnel should be familiar with the performance and safety knowledge of the products they sell.

Twenty-fifth fireworks export sales, in accordance with the relevant provisions of the state. Fireworks and firecrackers exported to the domestic market must be accompanied by Chinese discharge instructions on small packages.

Chapter VI Emission Management

Twenty-sixth fireworks, can not affect the production, work, study and rest of units and other residents. In addition to New Year's Eve, it is forbidden to set off fireworks and firecrackers in cities and towns from 22: 00 to 6: 00 the next day.

Twenty-seventh fireworks are strictly prohibited in the following places:

(1) Stations, docks and airports;

(2) Roofs, balconies and indoors;

(3) Hospitals and public places of entertainment;

(4) Areas within 200 meters around warehouses, construction sites, high-voltage transmission lines, communication lines, oil (gas) pipelines, places of interest, rural courtyards, forests, nurseries, etc. where inflammable and explosive articles are stored;

(5) Other areas prohibited by public security organs at or above the county level.

Twenty-eighth fireworks party or large-scale celebration, the need to set off fireworks or firecrackers, by the organizer to apply, after the county and city public security bureau for examination and approval, can be held.

Twenty-ninth it is forbidden to throw lit fireworks in densely populated areas and public places. It is strictly prohibited to use fireworks to stir up trouble, hurt others or destroy public or private property.

Chapter VII Punishment

Thirtieth in violation of the provisions of these measures, the production, storage, transportation and sale of fireworks and firecrackers have potential safety hazards, and it is pointed out that they are still not rectified, and the public security organ may order them to suspend business for rectification within a time limit. For those who refuse to make corrections, the county and municipal public security bureaus may revoke their licenses, and the Administration for Industry and Commerce shall also revoke their business licenses.

Thirty-first in violation of the provisions of these measures, illegal production, storage, transportation, sale, use or carrying fireworks, fireworks and firecrackers shall be confiscated by the public security organs, and shall be punished in accordance with the provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

Thirty-second, in violation of the provisions of these measures, in the production, storage, transportation and sale of fireworks, explosions, fires or other accidents have occurred, which have not caused serious consequences, and shall be punished in accordance with the provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-third fireworks in violation of the relevant provisions of these measures, the public security organs can carry out criticism and education. If the circumstances are serious, it shall be punished in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VIII Supplementary Provisions

Thirty-fourth before the promulgation of these measures, units that have been engaged in the production, storage and sale of fireworks and firecrackers have not gone through the examination and approval procedures in accordance with the provisions of these measures or have not gone through the examination and approval procedures in accordance with the provisions of these measures.

Article 35 These Measures shall come into force as of the date of promulgation. Where the relevant provisions of our province in the past conflict with these measures, these measures shall prevail.
