Legal basis: provisions on lawyers meeting prisoners in prison.
Article 1 In order to protect the rights of lawyers and prisoners according to law, these Provisions are formulated in accordance with the Criminal Procedure Law of People's Republic of China (PRC), the Prison Law of People's Republic of China (PRC), the Lawyers Law of People's Republic of China (PRC) and relevant regulations.
Article 2 A prison shall guarantee lawyers' right to meet criminals according to law. Lawyers should abide by the relevant provisions of prison management when meeting criminals.
Article 3 A prison shall announce the appointment method for lawyers to meet, so as to provide convenience for lawyers to meet. Lawyers should meet prisoners in prison. A prison shall reasonably arrange a meeting place for lawyers to facilitate lawyers to meet and read papers.
Article 12 If a lawyer meets a criminal and thinks that the prison and its staff hinder him from exercising his right to practice according to law, he may complain to the prison or its superior competent authority, or apply to the municipal judicial administrative organ where his law firm is located to safeguard his right to practice. In case of emergency, you can apply to the judicial administrative organ where the incident occurred to safeguard the right to practice.
