1. The right to add a defendant lies with the plaintiff. The defendant has no right to request the addition of a defendant, but can only add a third party.

2. Requiring others to bear civil liability for the criminal defendant’s criminal behavior must have a legal basis. Unless the law expressly stipulates that other units and individuals shall not bear civil liability for the criminal acts of the criminal defendant. Therefore, requesting to add another person as a third party requires providing corresponding legal basis and evidence, otherwise the court will not agree.

3. Whether the defendant can add another person as a third party in a criminal incidental civil case is still controversial in theory.
