Procedure of handling criminal cases by trainee lawyers

It is divided into three stages: 1, becoming a trainee lawyer 2, training a trainee lawyer 3, assessing a trainee lawyer 4 and obtaining a lawyer's practice license.

To become a trainee lawyer, you need to contact the law firm you want to practice and sign an agreement. Then the backstage of the law firm will ask you to fill out the application form for intern lawyer and help you arrange to assign a guidance lawyer. The condition for guiding lawyers is to practice for more than 5 years, and the internship law firm has not been punished by the industry recently. To apply for an internship certificate, you need to submit (1) the Internship Application Form filled out by interns to the municipal judicial administrative organ;

(two) the internship agreement signed by the applicant and the law firm that intends to receive interns;

(3) A copy of the applicant's legal professional qualification certificate or lawyer qualification certificate and academic certificate;

(four) to apply for a copy of the identity card of the intern, and the non-internship household registration personnel shall submit a copy of the residence permit or temporary residence permit issued by the public security organ;

(5) The resignation certificate issued by the intern's unit, or the file keeping certificate issued by the talent exchange center and other original materials that prove that I can engage in the lawyer profession full-time;

(6) A certificate issued by the public security organ where the intern applies for household registration that he has not been subjected to criminal punishment;

(seven) recent one-inch bareheaded photos of interns;

(eight) a statement that the law firm to accept the internship of interns meets the conditions stipulated in these rules.

If a person who intends to engage in the lawyer profession part-time applies for internship, in addition to the relevant materials specified in the preceding paragraph, he shall also submit the certification materials issued by the law department and law research unit of the university where he works.

Then the local lawyers associations will organize you to carry out training, and the training time will be arranged by the local cities according to the regulations of the Chinese lawyers association. After the training, you should pass the examination and issue a certificate.

The internship period is one year. Usually, the internship certificate is processed before the annual lawyer's practice certificate, in order to facilitate the lawyers who passed the internship last year to apply for the practice certificate. The Ministry of Justice stipulates that March and September of each year are the time to apply for a practicing lawyer's license. Therefore, those who wish to practice should prepare relevant certificates in advance and actively contact law firms and local judicial administrative organs before March.

I hope my answer can help you.
