Three. bidding requirements
When applying for notarization in a notary office, the parties concerned shall truthfully inform the relevant information about the matters applied for notarization, and provide authentic, legal and sufficient proof materials. The original of the relevant certification materials uploaded by the parties on the Internet needs to be presented and checked by the notary of the notary office on the day of receiving the notarial certificate. According to the Notary Law of People's Republic of China (PRC), Notary Procedure Rules and other relevant regulations, if a party provides false certification materials to defraud a notarial certificate, it may be investigated for civil liability, administrative liability and even criminal liability according to law.
Fourth, the bidding procedure.
1. In the process of using the online acceptance service of the notary office, you promise to abide by the following agreements:
A. All actions carried out in the process of using online acceptance services shall conform to the provisions and requirements of national laws, regulations and other normative documents and platform rules, and shall not violate public interests or public morality, the legitimate rights and interests of others, this Agreement and relevant rules. If any legal consequences are caused by violating the above commitments, the notary office shall bear all legal responsibilities independently in its own name and ensure that it will not suffer any losses.
B, abide by the principle of good faith, and do not engage in acts unrelated to online acceptance.
C. Do not publish information prohibited by the state, information suspected of infringing upon the legitimate rights and interests of others, information against public interests or social public morality, information that the notary office considers inappropriate to publish on the platform, and other information suspected of violating laws or this Agreement and various rules.
D. Do not use any equipment, software or routine procedures to interfere or attempt to interfere with the normal operation of the online acceptance service of the notary office. Do not take any actions that will lead to an unreasonable huge data load on the network equipment of the notary office platform.
2. You understand and agree that:
A. The notary office has the right to unilaterally determine whether you have violated the above commitments, and handle or terminate the services provided to you according to the applicable rules of the unilateral determination results without your consent or prior notice.
B. If it is confirmed by the legal documents in force by the state administrative or judicial organs that you have illegal or infringing acts, or the notary office believes that your actions are suspected of violating the terms of this Agreement and/or rules or the provisions of laws and regulations according to its own judgment, the notary office has the right to publicize your suspected illegal or breaching acts and the measures taken by the notary office on the notary office platform.
C. The notary office has the right to delete the information you posted on the platform that is suspected of violating the law or infringing the legal rights of others or violating this agreement and/or rules without telling you, and take corresponding measures that the notary office deems necessary according to the rules.
D. The notary office has the right to unilaterally determine whether the nature of your behavior constitutes a violation of this Agreement and/or the rules, including your behavior that has not been implemented on the platform but has affected the notary office, the platform and its users, and make corresponding penalties accordingly. You should keep all the evidence related to your behavior and deal with the adverse consequences of failing to provide the necessary evidence.
E. If it is suspected of violating the promise and causing damage to any third party, it shall independently bear all legal responsibilities in its own name, and ensure that the notary office will not suffer losses or increase expenses.
F. If you are suspected of violating relevant laws or the provisions of this Agreement, causing any losses to the notary office, or being claimed by any third party, or being punished by any administrative department, you shall compensate the notary office for the losses and expenses arising therefrom, including reasonable attorney fees.
3. Relevant processing rules
A. The online acceptance service provided by the notary office is to pre-accept your online notarization application according to relevant regulations. After you apply to the notary office online, the notary office will decide whether to accept your notarization application according to the provisions of the Notarization Law and the Notarization Rules.
B. If your online application is accepted by the notary office, you should actively cooperate with the notary office and notaries to complete all notarization procedures.
C. If your application is under any of the following circumstances, the notary office will not handle it:
A person without civil capacity or a person with limited civil capacity has no guardian to apply for notarization;
The parties concerned have no interest in the matters for which notarization is applied;
Matters applying for notarization belong to professional technical appraisal and evaluation matters;
The parties have disputes over notarization matters;
The parties fabricate or conceal facts, or provide false proof materials;
The evidential materials provided by the parties are insufficient, and they cannot be supplemented, or they refuse to supplement the evidential materials;
The matters applied for notarization are untrue and illegal;
Matters applying for notarization violate social morality;
The party concerned refuses to pay the notarization fee as required.
D in any of the following circumstances, the notary office will terminate the notarization of your application:
Due to the reasons of the parties, the notarization cannot be completed within six months;
Before the notarization certificate is issued, the party concerned withdraws the notarization application;
It is meaningless to continue notarization or continue notarization due to the death of the natural person who applied for notarization or the termination of the legal person or other organization;
The parties obstruct or hinder the notarization institutions and notaries from undertaking notarization in accordance with the prescribed procedures and time limit;
Other circumstances that should be terminated.
E. The notary office can provide you with services such as door-to-door delivery of certificates and door-to-door verification of evidence. The notary office will decide whether to provide this service according to business conditions and other factors. If you need this service, please ask the notary office and pay the reasonable expenses arising therefrom.
4. Related expenses
When applying to the notary office online through this platform, you should pay the relevant notary fees in accordance with relevant regulations.
The fees listed on this platform are prepaid, and the formal fees are subject to settlement.
If you need our on-site service, document authentication and other services, you should pay the relevant fees separately.
If the notarization application is not processed or terminated due to your reasons, if the notary office has reviewed it, the notary office will refund part of the notarization fee according to the relevant regulations.
